Re: Morgan Stanley Barclaycard sold to Lowell

normally I would send a sold in dispute to every new person who writes, I am aware these guys are all the same company, it's a tactic from them (not a very successful one) to scare you. But having a nice neat papertrail is a very good thing, especially if it ever came to court, then you could say "these guys were harassing me continually with letters from different companies" and lo, you have all the paper to prove it. I know it's a pain but it's part of the fight back, let them be aware that you are not going to be rolled over by their pathetic attempts to scare you into contacting them, they'll soon move on to some poor bugger who isn't as clued up.

Thanks everyone, I'm a bit wary as they have already mentioned a statutory demand in one of their threat letters. If they attempt this I'll immediately apply to set aside and try to hit them with costs!

Re: Morgan Stanley Barclaycard sold to Lowell

Just received a response from the Leeds losers to my legal threat template saying they are contacting Barclaycard to obtain details of the dispute etc. All they will find is a CCA request to Barclaycard in early 2010 followed by a dispute letter when BC sent a bodged cut & paste (recently confirmed by Niddy as UE)

I suppose I'm very lucky in many respects, all I have is this Barclaycard and a Cap One card taken out in 2006, total for both about £11500 with lots of charges - not sure on the status of the Cap One so may ask if Niddy could kindly take a look!

I guess its a waiting game to see what Lowell come back with.

Thanks Flowerpower, I'll definitely send to Niddy!

Lowell's letter was very conciliatory - apologies for our pursuance etc, no intention to harass, oblivious to any dispute, collection on hold pending BC response etc etc.

No further contact so far from Lowell since the above on 13 July....they're not exactly in a hurry are they?I suspect Barclaycard are not in a rush to supply them with evidence of any dispute, particularly as they sold Lowell a dud!
The legal threat template appears to have stopped them in their tracks! Will update if anything happens.

Well, since I sent the template letter recommended by Niddy last July I appear to be getting the silent treatment from Lowell.

I realise this is not the correct forum but just wondered if anyone knows if it is possible to reclaim charges on a business account? I have a dormant business a/c (limited company is dormant) with Barclays, there was approximately £60 in the a/c but over the past 18 months they have racked up the charges and it is currently £750!! No transactions occured as the a/c is dormant. I've called customer services but I'm wasting my time. Of course the local business manager who assured me verbally there would be no charges has moved on. Any ideas anyone?

Well, I had a call yesterday evening, the first contact since last September from a rather timid chap at Lowell. I asked him to go through my security before we discuss matters. A simple question really - combined IQ of all the phone drones in the office....answer between 1 & 9. The phone went dead!!! Hope I didn't upset him?
