      Ok, I've set it so that when you click an excel document it forces download - that seems to work....

          I have just re-read the letter from the FOS to me, a copy which was sent to Legal & General telling them to pay up.

          Did not notice it before but there is a small section in it saying because my wife suffered from depression at the time the policy was worthless. ?

          I have never said any reasons to anyone about my wife having depression and this was not the reason i asked for a refund as my first post says.

          They said to Legal & General to appeal by the 15th March, otherwise payup, would it be worth me getting hold of the FOS and telling them their mistake, as it seems they have us mixed up with someone else or see what happens next ?

            Hiya

            I take it you've not mentioned at all about wife having depression?

            If not and it's an error, do let them know your grounds of your complaint.

            However, if this has been mentioned, maybe they think it still comes into account that having depression is still a reason to make a reclaim (that's if anything of this sort have been mentioned to them within the complaint), but otherwise, do contact to correct.

              No we have not mentioned anything about depression ?

              but its passed the appeal time for L&G now, sorry was 13th not 15th, just had a lot of things going on at home and did not even see it.

              saw the part about FOS agreeing with us and skipped through the rest of the letter

                I have had the same letter from the FOS - Legal & General will pay up on the back of it.

                Just make sure what they pay you is in fact correct - dont be brow beaten by them.

                    No - Just the we (The FOS) agree & pay up bit.

                    I think it is worth a phone call to discuss the depression point.

                      Right, I phoned the FOS, and asked them about the depression part of their letter. They said that my wife was suffering from depression at the time the policy was taken out (really)

                      They said that one of the medications she was on at the time was an anti-depressant and it was on Legal & Generals paperwork. OK cant remember that but hey, so they said the policy was useless and to pay up/

                      Its now 3 weeks after the FOS deadline to Legal & General and still not heard a peep from them regarding paying up or anything else. The FOS said this is normal and they have not heard from them either.

                      Any ideas how long, or what happens now

                        Thank you for the update and that's good news then!

                        Right, it's been a while since I went through a complaint with the FOS, but from what I can recall, they send the decision to both parties around the same time and they give the business/bank a few weeks to get back to them to say if they agree or not, if they do agree then you should get a letter from the FOS to let you know this, and when to expect the refund, and if you've not heard anything or no refund by that timescale, the adjudicator will expect you to let them know so they can chase it up.

                        If they do not agree, you will also receive a letter to confirm this and at this stage it will be moved on from the adjudicator to the ombudsman, however's it likely the business will agree at this stage as it will only cost them more to allow it to go as far as the ombudsman.

                        Things may have changed over the years, so what I would do is email your adjudicator to ask what to expect next.

                          Just had a decision with FOS and we agreed with adjudicator.

                          We have a date by which the DCA has to have the actioned the suggested agreement by.

                          A signed agreement from us had to go back to agree to the action.

                          So basically up to where an ombudsman is involved can confirm that what Di has written above is correct as of 2 weeks ago

                            Quick update

                            Phoned the FOS to see if they had heard anything from Legal & General.

                            The woman said they had appealed their decision apparantly and it will now go to a second adjudicator which could take upto another 6 months. Not happy at all ��

                              They did the same with me - seems like their standard tack.

                              A thourghly unscruplous lot.

                              They even argued about the amount of redress once the FOS had finally forced them to pay up.

                              Conmen.

                              Hang in there and dont give up - thats what they hope you will do.

                                just a quick update as this has been going on forever now.

                                Phoned up the FOS to get an update on this as i have heard nothing, they told me it has been re-assesed as Legal & General contested it originally (but provided no reason why ?) and it has been found in my favour yet again, and has been passed to a specialist team at the FOS. did not give the reason why though, i assume because L&G are not corresponding with them.

                                Still ongoing, nearly 2 years now
