    Rang FOs - they have asked that I send copies of the statements.
    Eamiled them across - will post up what they say.
    Also thought I would email CEO of Amex to ask for hime to intervene - will let you know if I get a reply

    Hi Matty

    Thanks for your update, and good luck on the phone call.

    Remember if your not happy with the decision, you can ask for your case to be reviewed by the Ombudsman, but please be aware it may take some time.

    I see your point though, so hope they listen on the phone, it is known they sometimes overlook some cases, so speak your mind now while you can, good luck.

    Amex Update 7-4-2011

    Unfair charges claim

    FOS have not upheld my complaint,stating that they thought Amex's offer of £700+ was a fair one.
    It is about half what it should be and my argument is exactly the same as the one with the PPI which they have upheld and is now with Ombudsman.
    They have offered all charges back for last 6 years + CI up to October 2007 & SI @8% from then on.
    Problem is they have applied interest at contract rate for the whole of the period, so surely I should get this back + SI 8% in restitution.
    FOS have simply believed Amex's version of the story and have made the decision without contacting me,which I find staggering ,particularly as this claim has been split off my (upheld) PPI claim by them,which had the same interest issues and I proved Amex to be not being honest!
    They have also completly ignored the fact that I was charged membership fee even though I was on a fixed payment plan and was not allowed to use the card,ohh & they applied interest to the charges to boot and would not let me redeem the 19000 points collected.
    I am going to ring the FOS to question them - will let you know how I get on.

    Matty,

    What you could do is attach your letter/documents if you have the scanning facilities and send to the FOS and ask what you should do in this case, maybe they will contact them on your behalf if you ask them to.
    Or give the FOS a ring and explain what you received back, and ask if you should therefore contact A&L/

    Hope its not going to be a complicated one like mine.

    Info received yesterday from MBNA re the underwriters for the PPI....both the same which is not / cant be correct.

    I have received 3 seperate letters today from the FOS re 3 no claims I have ongoing with them.
    They all say the same thing - basically advising of delays due to the BBA action and advising of delays / that it may take more than a year to reslove some cases!!
    Me thinks that this is not a good sign........Damn

    Hi Matty

    Sorry for the delay in responding.

    Did you post your letter by recorded signed for delivery, and make sure they recieved it by checking it out on Track and Trace via Royal Mail website?

    If so and it was received, take a photocopy and send a chase up letter, tell them you know your letter was received because you have proof as enclosed, tell them your entitled to your documents in regards of your insurance and if you don't receive them you will be contacting the Information Commissioners Office to report this and to ask for advice.

    Otherwise, contact the FOS who may write to them on your behalf, explain your situation here that your letter have been ignored and your still waiting, if they don't offer then ask them if they able to write to them for you anyway, good luck.

    Good luck with these Matty. I never did pursue endowment mis-selling. With hindsight perhaps I should have... would have come in handy at the moment!

    Update on my Mortgage endowment mis sell claims:

    1st one with Standard life - sold to me by IFA who is no longer trading has been rejected by the FSCS as it was from June 1987 and not regulated at that time.

    2nd one - mis sell upheld by Standard Life ,but we could not agree on a compensation figure.
    Their offer I considered derogatory and have therefore passed on to the FOS for their veiw on the matter.

    3rd one with Legal and General,which included critical illness cover that I never realised I had been sold / included,has been rejected outright by Legal & General.
    I have therefore passed this over to the FOS for their view.
    The FOS rang me to confirm receipt of my claim and that they were awaiting information from Legal and General.
    However, they went on to say that after an initial view it didnt seem as though it had been mis -sold,as I had had 2 previous endowment policies.
    They also pointed out that they were aware of my claim with Standard life and that it had been upheld?
    I explained the reasons why the Standard Life claim had been upheld and also pointed out that at the time of taking out the L&G policy we had sold our house some time ago and did not have a mortgage attached to the Standard Life policies.
    We were looking for a new mortgage to buy a property and sought advice as to the best way forward for us.
    This seemed to make a difference to their view - time will tell.
    They did say that both claims would be looked at by the same person and that they thought that they would be able to make a decision quite quickly.....not sure if that is good or bad.

    Hi di hope all is well with you and your quests.

    Just a quick update re my MBNA ppi reclaims.
    I wrote to them on 16/02/2011 asking for details of the underwriters for the PPI at the time I opened the accounts.
    I have not received anything back as yet and now wonder if this is a clever tactic on their part knowing full well that if they dont provide the information to me , I have nowhere to go with these claims?

    I have however,whilst searching for something else,turned up the original insurance booklets for each account.....not sure if I should give MBNA a chase or simply crack on and have a 'go' at the insurers (Consolidated Marine & General Insurance Co Ltd / A&L Visa Card and ITT London & Edinburgh for MBNA Visa Card)

    Matty to what I'm aware of, the ombudsman 9 times out of 10 agree with the adjudicators decision, and I think you will be ok.

    You could try to get a figure posted out to you, to know what is what.
