    All done Niddy, and a new thread has come up with all my docs showing, is that just me and you and your solicitor that can see it as I hope Ive not f##cked up, could you check mate.

        It can be disconcerting when you see a new thread dedicated by your documents but as you have guessed t is highly secure and protected so that you and Niddy are the only ones who can see it.

            JUST you and me mate. It's secure - 100%.

            However the agreement and terms you sent would be enforceable so time to consider your options whether you wish to fight this (by blagging it) or try and settle it - as I have a contact at 1st we could try and get you a favourable deal if you did decide to settle - if not you'll be blagging it.....

            I have explained more on the secure thread with the uploads.

                Didn't you say this hasn't been paid since 2008? You need to find out the date of last payment as it could well be Statute Barred.

                  Yeh I was thinking that I am just going through it with Niddy at the moment, as does the 6yr thing start from the last time you made a payment? I think I need to find this out therefore I think it would be a SAR wouldn't it.

                    See what Niddy says about the SAR.

                    If you were making your usual contractual payments and suddenly stopped, time would start from the day after the first missed payment.
                    If you made your last payment after the account was defaulted, it starts the day after the last payment.

                      I would not rely on a SAR to show that - creditors have been known to make up 'phantom' payments. If you've got 6 years of bank statements go through them with a fine toothcomb (unless there is the possibility you've made a cash payment over the counter).

                      You also need to consider whether you've 'acknowledged' the debt in writing during this time (you don't need to worry about using the AAD templates as they are carefully worded to avoid this).

                        The last payment I would of made was from after I defaulted so your taking 2009/2010 maybe, I've had a brief look over the letters I've sent and it dosent look like I've actually acknowledged it, instead Ive put, in relation to a Halifax account, or an aledged debt to Halifax PLC, so I hope that was the correct way to address itand thats naughty about phantom payments. Ive not got 6 years of bank statements should I write to the bank and request?

                          Hello everyone,
                          just a quick update regarding this debt to 1st Credit, with the invaluable help of Niddy this has now been paid and settled (partial settlement) and I've now received confirmation back that the account is now closed and they wont be selling it on or pursuing me in the future this included written reassurances from Niddy's contact in 1st Credit so again many thanks my friend and to everyone who offered their time to advise on this, its very much appreciated.
