Ahh ok..that's not a formal default notice, just a notice of default sums. I know it's hard putting up with the hassle but worth it to get it terminated ASAP and charges/interest stopped. Won't be long

They can only threaten, no one can actually do anything before it's defaulted and terminated, at which point he writes with a payment arrangement.

that's good then it will have to be low something like £5 a month for the time being as his hours were cut .

My son received this today from Mercers debt collection limited

Even though you have been sent letters requesting payment from Barclaycard, you are still behind with the payments on your account. Barclaycard has therfore passed your debt to us Mercers ) to collect on its behalf.Mercers debt collection limited is a separate company withing the Barclays group.

Under the terms of your agreement condition 2 states that you must make at least the minimum payment each month by the date shown on your monthly statement. As you have missed a number of payments and your account is still overdue, you have now broken this agreement.

What you must do to bring the account into order.

You must a payment of £160.12 so that it reaches Barclaycar before the 30 April 2013.

IF YOU FIND THAT YOU CANNOT PAY, YOU MUST CALL MERCERS IMMEDIATELY

Please be aware , we are also legally obliged to inform you of the following information.

IF THE ACTION REQUIRED BY THE NOTICE IS TAKEN BEFORE THE DATE SHOWN NO FURTHER ENFORCEMENT ACTION WILL BE TAKEN AGAINST YOU.

Your account will be closed, if this happens you will still be required to repay the outstanding balance.
Barclaycard will send a formal demand, This will ask for repayment of the whole balance ,If you do not pay this, they may take further action to recover the balance in full.

We must also make you aware that we may tansfer monies that you hold with us in a Barclays current,savings or other account to reduce or repay in full the amount you owe us in accordance with our right to set off.

That's good, they're on the verge of defaulting and terminating after 30th April.

Their letter is worded similarly to a Default Notice but it isn't one. Any chance you could scan it and post it up (after removing personal details) for checking?

In any event, your son is almost there. If it was me I'd just sit tight a little longer and let them terminate. Then we'll sort a letter for the payment plan
