Potentially selling a house and a unresolved land registry issue & unpaid credit card debt

    Hi all i need some advice please with regards to the following, my sister and i inherited my late father's house which we are currently living in. We have not as of yet updated the land registry details but i've just been told by a family friend that if we wanted to sell the house this would not be possible because i have an outstanding credit card debt which can be found here when i was using a another forum user name.

    So can a house be sold if you have a credit card that has not been paid since 2010 because my sister and i are now under the impression that unless i clear my debt we cannot sell the house, and that land registry details are open to the public domain and perhaps the people who i owe money to would see that im trying to sell a house.

    Well seems well the Credit Card debt is well and truly Statute Barred.
    There is NO CCJ against you for this Debt is there?

    Your late Father's Property presumably didn't have a charged registered against it in His name at the and Registry Office?
    I can't see how this Debt can stop you selling the House!
    Without a CCJ they would have no right of claim against your Share of the Sale proceeds!

        Like Roger, I can't see how your credit card debt can prevent selling the house. It's more a case that you're worried that the sale could bring creditors after you. Your previous thread from January petered out. What transpired with Resolvecall and Intrum?

          With Statute Bar I personally take a pessimistic view. Have never sent the Statute Bar letter if they want to waste money on stamps so be it!
          But as you are anyway talking of selling a property I strongly suggest talking to Colin G Quinn the first Consultation is Free

            I can assure you that having a credit card debt, even having a ccj can not stop you selling a house (This is from personal experience).

            It looks as if your debts are indeed time barred under the limitations act 1980.

            Not sure why you haven’t sorted the land registry , I assume you went through Probate.

            If your creditors are not bothering you do not poke the hornets nest

              By the way/ you may get a letter from Intrum threatening a visit. I know I have and NW has but no one has turned up. Just ignore it

                The probate was completed but the land registry is in the process.

                    If the house is in your sole name and there is a charging order based on a CCJ on the Property you are selling then yes that would have to be paid before the property could be sold as the charge holders consent is required

                    If the house is in joint names then, depending on the wording of the restriction, your conveyancer only has to give notice of the sale. No written consent from the charge holder is required.

                      If there's no CCJ on your credit card debt, you can sell the house just update the land registry and check with a solicitor.
