Re: Barclaycard - markers and contact

Well our records show last payment in feb 08 so if 1 starts in march 08 I guess the 6 is September 08 but in terms of 29th I don't know.

Re: Barclaycard - markers and contact

Barclays have seen the light on these AP markers and are actually doing the right thing. The first bank that seems to be doing this.

That said this is the first time I have seen them do it on their own accord as its usually after a consumer complaint.

One would suspect it is the prelude to a flurry of activity or getting sold on. Its quite obvious the conditions are now right for the banks to start unloading debt that was just kept on the banks book just to look like an asset.

Other users have posted today after receiving similar letters.

I'm expecting one because they hadn't defaulted mine the last time I checked my credit file in January 2011

If you last paid in February 08 then they have probably applied the default within the time scale ...even if they appear to have left it to the very last day

Re: Barclaycard - markers and contact

                I would ignore.

EDIT: just seen that it's post 2007 so best not to ignore. Have you ever sent a cca request for this (even though it's post 2007)? If you haven't then I would send one asap. Hopefully it will buy you enough time for the debt to reach SB.

Re: Barclaycard - markers and contact

When I started this process it was august 2011 and I'd not heard from Barclaycard since may 08 so not sent a CCA request on this, you think I should then?

What happens if they set the £1 against the debt - it'll restart the clock....

                    Thanks!!

Re: Barclaycard - markers and contact

It specifically says in the cca request that the £1 is not to be used for any purpose other than as the statutory fee for a cca request. If they use the £1 as payment against the debt we'll sort it out for you.

Phew!! Thanks... I've noticed on other accounts that I have had my £1 refunded onto the "debt" but glad it can be sorted if they do!

                          Sending CCA request today.

                              Ok!

                              got a letter from barclaycard

"I enclose a reconstituted copy of your credit agreement together with a copy of the terms of your credit agreement as varied in accordance with section 82(1) of the act.

We know that your account is not in dispute because any delay in providing your copy document as section section 78(6)(b) was repealed on 31st May 2008"

letter also confirms that that the debt has not been reassigned.

ive never had one of these no no clue what to do next BUT statute barred by end of March 2014 given default will be 28th sept 2008 and no payment made since account was marked late 6 months prior to the default date they now record.

checked and account was opened Nov 2007.

                              Worried now......

Reading up on other posts - should i send an Subject Access Request to Barclaycard? Would this buy me sometime and also confirm when the last payment was actually made?

                                Thanks in advance!
