I have now received a reply from Drydens dated 7th August although i only received it on19th August. The letter stated that the Client which is Arrow has confirmedt hat they received a payment from me for £73 .00 on the 1 June 2010. therforet his matter is not statute barred. they also said they are looking forward to hearing fron me within fourteen days for my proposal for payment. We are already nearly 14 days from the date of the letter and I am due to go on holiday on 20th August for 2 weeks, is it possible for them to issue a SD within the 2 weeks while I am on Holiday?

Rod you need to send the SB letter to Drydens solicitors because they remain instructed by Arrow, even though it was Arrow who wrote to you last enclosing the CCA docume

This is because Arrow's letter specifically told you to deal direct with Drydens not them.

If so they should have responded by now (40 days) and this may help with proof that this debt is statute barred which you believe to be the case. You should get back the statements showing the last payment from you, unless you made any payments to Arrow after they purchased it.

Yesterday I emailed you a reminder to send for a SAR to establish when the last payment was made. We suggested this last September but it seems it may have got overlooked.

If you need help in doing this please post on your thread.

The SB clock doesn't stop until a claim is issued, so it should hopefully now be SB based on your first posts. If they haven't supplied enforceable documents then you are in a strong position. Is there no way of checking when your last payment was made?

if it turns out that a payment was made just under 6 yrs or just over 5yrs would this means that they will be in a stronger position than are in now?

Hi Rod, they'll get back to you as soon as they can. Plan B is away at the moment and it usually takes at least a week or two for Niddy to get chance to check all the agreements he receives unless it's urgent eg there's a court case in progress.

Give it a week and if you still haven't heard anything give us a shout
