    Niddy has told me that it's UE, yippee!
    Had they not been greedy, then I would have just carried on paying, but now it's a different story, so letter in the post on Monday.

        Yes, I sent a CCA request in 2007, they sent a copy of the application form, which shows my signature and states "This is a credit agreement regulated by the Consumer Credit Act 1974."


        They did indeed send the application form however they never sent the correct terms, they have sent some blanket terms but not the ones that should have been presented with that agreement/card.

        I gather no terms came when you received the card either? If not then you'll not have to worry too much about this, regardless the small balance is enough to make most walk away.

        I would respond with the Missing PT's template as per my PM.

          They will not try for a CCJ for a debt of £600 odd......

            My only concern is that they have several of my old accounts and could attempt to make them one claim, particularly as they have added approximately 4k in interest to one of them alone!
            I will scan the others and forward to Niddy, so that I have clearer picture on how I stand.
            The letter for the missing t&c's will be posted on Monday.

              These are all separate debts?
              I am sure they can not "roll them up" into one but as normal if I am wrong someone will me.
              Do they own or manage the debts....

              Lets just hope that some or all of the others are UE, remember that even if they are EN there are other avenues that can be followed which will stop them winning in any court action

                Cabot own the debts, or at least the rights!
                I am reasonably confident that I can challenge their right to enforce on all of them, but they add up to just under 13k, so having previously had CCJ's, I prefer to be sure of my argument and fully understand the points that I raise with them, however, how brilliant to think that 13k could be UE to Cabot They used to make my life a misery before the Cabot Fan Club of old and understanding how to challenge them.

                    Quantum are part of Wright Hassle Solicitors.

                    It seems Cabot has given up on Morgans their own inhouse crew, and instead have moved everything to Quantum / Wright hassle, something of an apt name when dealing with cabot in my opinioon

                      I have just attempted sending one of them, but have had an error message about a missing security token, so will wait to find out what the problem is with that.

                      On the Associates account, they have have failed to supply any documents since 2007 and Providian they have only supplied statements, so those two are certain to be UE.
                      The other one that they are pushing for payment on, is the Citibank account and I have tried to send the details to Niddy, but despite their protestations, that is also likely to be UE.

                      So just the Creation account to sort and a letter will be in Monday's post

                        That's a good question Experto Credite (MBNA) put both my separate credit card accounts on the same statutory demand I'd love to know whether a creditor can do the same thing with a county court summons if they word the POCs correctly

                            Ive heard about it but never have i got one of these matters to trial, so i do not know how the court would deal with that

                              I can see how proceedings for more than one account at the same time may advantage a creditor if a single account was less than £5k (small claims court) and they wanted it propelled into the Fast Track for costs reasons.
