Hi Joanna If you remember they wanted to have there day in court , I decided it may be an expensive gamble so I decided to pay them at 20%discount via there solicitors , I started a complaint via the Financial Ombudsman , spoke to them & sent 90 pages of stored correspondence & supplied information much to Pra’s disgust the Ombudsman upheld my complaint & Pra Group had to pay me all the money back with the admission that the account was unenforceable , the moral of the story is gather as much information as possible & stand your ground.

Thanks Diana I did a while ago & he reckoned unenforceable on the guidance of how you won your first case against Pra , I was unsure if Niddy was still involved as he was unwell last time I contacted , I will contact him with my latest & of course publish the whole story on completion, looking through both Cra bundle a lot of inconsistencies are showing up as to dates as to ownership , I thank you for suggesting getting both Cra's hit has flagged a lot up.

As I said in post # 77 you need to email credit agreements to Niddy for checking.

If you've received a credit agrement then email it to Niddy to check for enforceability using webmaster@all-about-debt.co.uk

Hi I was hoping Diana our Pra specialist would help me with my latest update , I have e.mailed you some paperwork this morning , Diana can you let me know you have received it , I would prefer to keep of board for now , just one thing to put out there although it seems nobody is about this week, how can Mbna sell a debt in 2010 yet re assign it to someone else in 2017 ?

I have now received a Cra from Pra Group & one from Mbna, my intention is to reach a f&f settlement rather & go to court , I feel my Cca request was never supplied as requested yet they went legal, as it stands I have a blurred box agreement illegible , the date on the first one they sent me was 2002 the second they sent was changed to read 2003 the terms & conditions do not match the charges or interest for that year , Pra do not seem to be able to prove they bought or own the debt , there is nothing referring to them purchasing or Varde selling the debt to Pra Group on either Cra yet there solicitor is pushing for me to make them an offer, it is my belief that this alleged debt is still in dispute from the original Cca request not being satisfied & as such should not be in the hands of there solicitors surly it should be passed back to Pra Group as technically in dispute still , how can I make an offer to a company that do not own the debt in the first place as I doubt they will be able to prove ownership at all ?

Is there any reason why you started this thread in the Debt and Housing section?

You may get further help and support if it's in the Unenforceable Agreements forum.

    Think positive

You're not being a pest for asking questions

It took a three day hearing at the Royal Courts of Justice (with several hundreds of pages of documents under scrutiny) to decide whether PRA 'owned' my account or not. I say 'my' account because what works in one case may not work in another.

If your aim is "to see the back of this without court action" then a settlement of some sort would be the only way.

You say PRA have not been straightforward to deal with and I won't disagree with that - they can be very aggressive in their pursuit of money and litigation seems to be their weapon of choice. Debt purchasers often are aggressive sadly.

However you say that you feel Brodies solicitors are being "helpful" and they have requested all sorts of documents. So presumably they have called off the dogs for now?

I want this to end problem is Pra have not been straight forward to deal with , I have dealt with others before , I thought Vanquis where difficult but at least when it looked like court they allowed reasonable f&f settlement how do you see this going from here , as you said I have sent Sar to Mbna & Pra , can you explain I don't understand what you mean about the debt ownership & whose playing smoke & mirrors I do want your advice & help to get this to end but I need to be able to understand what you are meaning sometimes , I want to see the back of this without court action , the way I see the trail although I am only an ametuer Experto bought the debt , Aktiv colllected for them followed by the new name Pra , Experto go down the tubes , so who owns the debt what is the actual chain , have Pra just made claim to it since they handled the account , honestly Di I just want your help to get this ended if there paper trail is wrong & unenforcable tell me , are they correct do they have the correct paper trail is it me that is in the wrong sometimes I feel I am being a pest asking these questions .

I also wish that you and your wife finish this once and for all but complaining to all and sundry may not achieve that aim.

    PRA are litigious.

I also know that you may have misunderstood who was collecting/owning the debt as the years went by. Perhaps this was a case of 'smoke and mirrors' (intentionally)

Mbna Sar sent recorded the other day , I will send one to Pra first thing Monday , I believe the Sars will show up the mistakes ,I remember from my Payplan dealings it gave you most of the trail but you cannot get access to that information later , Mbna did sell to Experto , Aktiv did the collecting as do Pra , I do not believe they ever purchased the debt from Experto so therefore not there's to chase , I believe things have been conveniently missed over the years by them , my one & only wish is to have this finished once & for all.
