Is there any reason why you started this thread in the Debt and Housing section?

You may get further help and support if it's in the Unenforceable Agreements forum.

    Think positive

I have now received a Cra from Pra Group & one from Mbna, my intention is to reach a f&f settlement rather & go to court , I feel my Cca request was never supplied as requested yet they went legal, as it stands I have a blurred box agreement illegible , the date on the first one they sent me was 2002 the second they sent was changed to read 2003 the terms & conditions do not match the charges or interest for that year , Pra do not seem to be able to prove they bought or own the debt , there is nothing referring to them purchasing or Varde selling the debt to Pra Group on either Cra yet there solicitor is pushing for me to make them an offer, it is my belief that this alleged debt is still in dispute from the original Cca request not being satisfied & as such should not be in the hands of there solicitors surly it should be passed back to Pra Group as technically in dispute still , how can I make an offer to a company that do not own the debt in the first place as I doubt they will be able to prove ownership at all ?

As I said in post # 77 you need to email credit agreements to Niddy for checking.

Thanks Diana I did a while ago & he reckoned unenforceable on the guidance of how you won your first case against Pra , I was unsure if Niddy was still involved as he was unwell last time I contacted , I will contact him with my latest & of course publish the whole story on completion, looking through both Cra bundle a lot of inconsistencies are showing up as to dates as to ownership , I thank you for suggesting getting both Cra's hit has flagged a lot up.

Hi Joanna If you remember they wanted to have there day in court , I decided it may be an expensive gamble so I decided to pay them at 20%discount via there solicitors , I started a complaint via the Financial Ombudsman , spoke to them & sent 90 pages of stored correspondence & supplied information much to Pra’s disgust the Ombudsman upheld my complaint & Pra Group had to pay me all the money back with the admission that the account was unenforceable , the moral of the story is gather as much information as possible & stand your ground.
