Ok, please guys lets keep this off here. I would suggest you PM each other and you'll see this is a misunderstanding.

It is not working planB. I have spoken with the site's owner and I am out of it completely voluntarily I hasten to add. Therefore you can report back that has failed. I will not be party to anything where the OP wilfully has stepped out side the law by his own admissions and ommissions and asks us to remedy his problems whilst refusing the very good advice he has been given. You clearly have further insight from your own comments into what he/she is doing than we do on this thread and be complicit in reducing the credibility of this forum.

          regards

I have already reported the whole matter to the site's owner as the very best advice was given to the OP at the very outset but as time has worn on there have been contradictions refusals to answer the most simple of questions and still we have the reluctance to go and get legal advice seemingly now full backed by yourself which I see as something far more sinister when I check my personal e-mails from a very good friend of yours. So I now take your rather rude comments as being deliberately set out to wind me up. And have you sought out proper legal advice on the OPs behalf. No I did not think so. I did and quoted the OPs posts to them calling in a favour. I reported back here for everyone's benefit but it is now my oopinion that this thread has another agenda.

Please tell me what agenda.I have taken advice from this Forum in the past I contacted Paul and he passed it on to Andrew,Andrew who I believe to be a Solicitor told me it was a negotiating situation so I negotiated .I got back in touch with Andrew yesterday and had a reply in my in box this morning telling me he was unable to help I believe Paul is in the middle of setting up a new practice I will be in touch with him to see if he can help.

I don't think its a Probate solicitor I need, could be wrong but a Litigation solicitor am I wrong.

            Regards Streetwise.

Ok, being as it's out now you may as well know! Yes Paul is leaving Watsons, in the next week or so. He will still be around, as will the staff from Watsons albeit Watsons is closing it's doors as it's current incarnation (as I understand things).

At the moment too many details are sketchy so as streetwise has said, when Paul is setup he'll then be able to instruct him. Right now that's not dooable I suppose what with what is going on.

No reason for panic or alarm, things will continue as they have always done.

Have you had the two flats valued recently to see if there's any potential for a shortfall? It would also give you an idea of how much equity (if any) is in the properties. This in turn may help you decide how badly you want to fight this battle particularly if legal fees become an issue.

Have you read Bleak House by Charles Dickens because that novel says it all. I did it for 'O' Level many moons ago but I haven't forgotten the book's message:

so Streetwise, have you had anything in writing from the bank to explain this situation (the passing of the flats to your partner's partner)?
Has the business partner nothing to say about the situation or is he happy to sit back and see your children's inheritance pass to him?
Is the business partner a British citizen?
So what did the partner get back when he sent the SAR to the bank? and have you seen it?
I'm not really interested in the tax ramifications or anything else other than finding out what actually happened, you need to go to a solicitor and tell him the whole pertinent story, pertinent being the operative word here.
If the bank have acted unlawfully it can be stopped but easier to stop it sooner rather than later and as I said before never believe they are looking after your interests.
The flats haven't passed to my partners partner just the bank account her name was removed from it in January 2011.

There was hardly anything in the S.A.R, and no loan agreement.

Her business partner is a British citizen.

No haven't had the flats valued lately, thought the bank might come round to my settlement proposal.

Not read Bleak House either by the sound of it I better stay away from it.

No need to apologise. It's fine. Andrew confirmed he has had to knock this back so for now so just keep in contact with Paul ready for when moves on

I'm sorry but what bank account is this? Is this the bank account that the payments for the flats go in and out of, ie mortgage payments and any rental income?

Did your wife's business partner ask where all the info had gone?

May 2011 the bank write back saying they can not locate an account for my partner with these account numbers.

May 2011 i write back to the bank explaining these are the correct account numbers and she is party to a loan that she received from them with her business partner.

July 2011 the bank write back telling me that the account had been transferred out of her name and solely into her business partners on the 1st of January 2011.

The Bank closed the account. The mortgage account, so as we could only pay into it.Banking facility withdrawn .

The S.A.R. didn't have much as there was never much contact, bank getting payments on time and correctly nothing to talk about but there was no loan agreement in the S,A,R.You don't get much information in a S,A.R. if everything is running smoothly.

The rents are paid into another account in a building society, every 3 months I pay the bank that lent the money there quarterly interest.
