Di yes - in effect the consumer is frequently at total war with the FOS and they are without doubt clandestinely set in place to uphold the alleged dignity (lol) of the UK banking system.
Of course, many of us who have been treated like sewer rats by this appalling and self-righteous outfit know the truth but until others feel its biased wrath, on a personal basis, they will continue to think it is somehow impartial or even on their side. They used to say the same in the 1930s about a certain little German guy's political position...
My own wins for comp against FOS have been when I have proven belong all reasonable doubt that they have been caught wanting. Most folks however will not file every page away like some of us do and so will have to tolerate their pro-banker stance!
All a mega mind screw against the trusting consumer and one that MUST be exposed in the end!!!

They have as well got worse over recent years, I did have a few with them in earlier years just before I knew much about reclaiming etc and back then I found it was more straight forward, the big one I had with them was about Nemo Finance , quite a big case in 2007, won that one with further compo and overall not as bad as they are now, this is the first time I have had a bad time with them and in my view I did NOT at all find they were impartial, then researching on the decision makers background 9 times out of 10 they did belong to banking industries, and this is the first time I have put in my own complaint about the service, but still the "ombudsman's manager" agree with the Ombudsman.
However, what I must say was that it was here and there, recommended to be not upheld then to be upheld then not to be upheld again, but finally with the help from our Niddy we succeeded with a partial win, better than nothing but no success in making that complaint to the service manager, being ill too they are fully aware of that and have been from the start of the case.

We'll help best we can. As for taking action; against whom exactly? You cannot sue the FOS as they're only forming an opinion. It's not legally binding (like a court judgment) if one party declines the decision hence it'd be whoever you complained about that you'd be looking to sue.

Get the ICO in agreement FIRST so ask the adjudicator for a 30 day hold pending ICO clarity of incorrect default.
Do not send it to an ombudsman yet. Pointless.

Carole Auchterlonie is her name and boy she is full of shit.
This is a quote from her boss I received yesterday
"amongst other things - any relevant law and regulations"
When I pulled her up on this little matter and asked her to explain how this regulation had been followed
CCA s.88 (2)A date specified under subsection (1) must not be less than [14] days after the date of service of the default notice, and the creditor or owner shall not take action such as is mentioned in section 87(1) before the date so specified or (if no requirement is made under subsection (1)) before those [14] days have elapsed.
she totally froze up and refused to answer my question.
Makes me bloody sick to my back teeth. They are so corrupt and they really son't give a shit that everyone knows they are.
Anyway, making an official complaint tomorrow morning with the OFT and the ICO have asked me to fill out their complaint form so they can look into what Sainsbury's have actually done.

Morning all,
Got a response from FOS regarding Countrywide and it's either me or this guy contradicts himself.
I did speak with FOS and they are starting a complaint process for me which will lead to an independent review of the Ombudsman decision. In the meantime I have to write to them with my concerns so all comments welcome as always.
I'm off to work but will start an new thread when I return and post his decision.
