On second thoughts.... I'm a bit reluctant to put the car. reg. details and Parking Charge Notice ref. in there.... Curiosity killed the cat and all that.....

Just for the record, my mum received a parking charge notice in October 2011 which I told her to ignore. After several letters, they have finally given up.

Hubby received a parking charge notice in August 2012. Several letters have arrived which we are ignoring; not sure if they'll be any more but we have no intention of paying it.

Both were in car parks where there was no option to pay for a ticket. Mums was a charge for overstaying the three hours. Hubbies was for parking outside of a marked area (he was loading whilst working so pulled up in a non-marked zone).

Either way, we would defend on the basis that they cannot justify the "charge"...

I'd continue to ignore and ONLY worry if they take it further, which in our own experience, they don't xx

P1 - PLEASE listen to me! I don't think I've EVER said that here before. I've dealt with hundreds of these OTR, and must have dealt with the best part of 60ish since the new legislation. Nobody has been done.

Do not get tied down in the new legislation and the finer elements of it. Just ignore or appeal and then ignore. If you really want to read the fine detail go to a website called Pepipoo which specialises in motoring issues, it tells you absolutely everything there. Just Google it.

Do let us know, but don't panic. You are likely to get a series of increasingly threatening letters. The last one I had had, their final letter was really quite scary, but they've done nothing.

I've even got to the stage I have tickets in my wallet which I put on windscreens of cars which have been issued with one of these speculative invoices (that's all they are), directing them to a site where they will get support and telling them not to pay. I'm afraid I even directly confront the ticket issuers when I see them and ask them what they think they're doing. They really get quite flustered a lot of the time (as does my wife who hates me doing it). If I can waste their time giving one poor soul the chance to escape this idiot, it's time well spent in my book.

They've now traced my daughter through DVLA records and want her to divulge the name of the driver under the Protection of Freedoms Act 2012.

Isn't that an odd name for a law that has the opposite effect?

No, because POFA requires that if the RK alleges someone else is driving, in order to place liability on that driver, they must supply a name and current service address. Failing that the PPC can chase the RK.

Might one get away with replying that the driver could have been one D. Cameron of 10 Downing Street, London?

The company will have a complaints procedure. Tracking your daughter through the DVLA database (how do you know this is how they did it?) is a total abuse of their access to the database.

This issue is nothing whatsoever to do with your daughter. If you can prove this was the case, I would make a serious complaint, not only to the company in question, but also to the ICO, POPLA and anyone else you can think of.

She was parked for 5 minutes in a car park at her uni. campus and went upstairs to get the permit from her friend who lives on that campus. When she came back, the bloke was already writing a ticket out.

Friends at uni. have told her to ignore it but I wanted to check it out.

That suggests yes, she was the RK & Driver but not the permit holder.
