Letter received today from Moorcroft saying that they've requested the relevant documentation from LTSB and will suspend collection activity until they get it.

They go on to say "we believe it may be of assistance to all parties if we also take this opportunity to ensure that any potential areas of dispute are addressed prior to any possible court action or further investigation. To this end can you provide an indication of the information you will be replying upon, when giving evidence to the court or information to the relevant statutory authorities in relation to the alleged subject matter of this account."

They go on to request the information by return to "minimize potential costs and delays"

I haven't had a letter like this before...I assume I would just ignore it and see what they send next?
Hi Pixie,
I've had one of those after a CCA request..it's their standard template to try and rattle you by mention of court. I ignored it.

Just to tie it in, after telling me they had no agreement due to age of current account, my OD a/c was then passed on to another DCA who came in threatening legal action. Responded with a complaint and it's now on hold again. Thread here: allaboutFORUMS
I sent the cca request without the PO but they said I needed to send PO.

I didn't have the couple of pounds spare...bloody DWP, kids having accidents and having birthdays.

I'll borrow the money and send cca request off today.

    EDIT: sent 5th July
It's not such a bad thing though it delays the process a bit longer :grinning
A spare couple of quid is harder to get hold of than you think!

I'll copper up and send a PO. Let's see what I get back :lol
I didn't manage to copper up the couple of quid to send a PO :frown

I've now received a litigation warning letter from Midas Credit Services (obviously still part of Moorcroft) It says that as I've failed to reach a repayment agreement they are reviewing the account prior to the possible recommending of legal action by external solicitors acting on behalf of their clients.

Any suggestions as to what I should send back (if anything)?

    Well spotted !

As the loan is secured and runs out in 2-3 years I didn't think it wise to mess around with it, I classed that one as a priority debt, and as such am paying it 100% each month.

Can anyone offer any advice as to my options, what I should do/send to start getting this sorted out ?

Many thanks for any advice given.
In your diary you say that you have a mortgage on your home, a credit card account (£7k), and a secured loan all with NatWest but I can't see the details of that loan on your thread :confuse2

Natwest OD - why are u paying £1 per month?

I'd stop and try and get it SB. If they get heavy then try utilising the OD template but if you're paying you need to reclaim charges so it may be best stopping all payments for now. Save the £1's and if they get too heavy then consider an offer. OD's are exempt from traditional s.78 fights.

The above is what I'd do anyway :beer
I sent the template letter to Moorcroft for my LTSB OD. I didn't get a 'go away' letter back but a letter saying that I must provide the £1 fee for the request to be actioned.

Not sure if I should send £1 PO or not?
You're not requesting info under CCA s.78 are you so no, no £1 is required. However I'd be tempted to send it and see what they say/do.... if you can afford a spare couple of quid of course :pale
