    This case centred on costs recoverability in the small claims track.

    The Claimant recovered its costs by placing reliance on a term in the contract which allowed it to recover all costs incurred in suing a person to recover the money owing.

    Now then, the point here is that if the contract has a term such as shaws did, then on the principal of reciprocity you too should be able to rely on the clause to recover your reasonable costs incurred in the course of litigation as well.
