        Hi everyone,

        Trentt21 I have read this thread and I have received your DM. Welcome to AAD.

        If the LOC expires in a couple of weeks, let's consider if a CCA request at this stage is going to achieve anything of real value to you.

        If you post a CCA request it is deemed served two days later and the creditor has 12 working days to comply. By that time the LOC will likely have expired, and as I always say, if a creditor is going to issue a Claim, it will issue regardless. A valid CCA request being received does not debar a creditor from issuing a Claim, it just prohibits it from entering Judgment until that request is complied with (although, sadly, if a consumer represents themselves, or if the issue isn't properly argued by Solicitors for example, that doesn't stop Courts erroneously finding a request has been complied with).

        In response to your DM, please feel free to email me the LOC to review. I hope everyone on AAD, whether a new member or veteran, does not feel the need to ask permission to contact me. I am happy to hear from anyone.

        In my experience, a lot of these 'Aqua' accounts are unenforceable, or not agreements with the alleged original creditor, and the assignment issues which arise out of the same are substantial, and often inexplicable.

        My initial thoughts are that a CCA request at this stage will not prevent a Claim being issued, and may actually assist the creditor in 'rectifying' issues in its own case.

        I am currently instructed in case a whereby the creditor has, by way of my strategy, confirmed it has issued a claim against a consumer with no information or documentation in support of its case. I am instructed to apply to strike that Claim out at a very early stage.

                            As you point out a Typo error!
                            Tactics are a different perspective which is overlooked!
                            It requires a judgement and assessment at an individual and personal Case level.
                            Hence my reaction of NOT pressing for further information! The LBC is being used to ensnare and Case build against the Debtor!
                            Look at how important the AAD Diary format is! Especially where perhaps we need professional and private legal advice!

                              Hi all,

                              Cabot UK have issued court papers against me for two old CC debts, in Scotland. I'm confused by the posts here as to whether they are authorised to or not? Can anyone clarify please? I'll also email Colin.
