    Type of account: HSBC Managed Loan
    Date commenced: 07/04/06
    Approx balance: £10,300
    Date last paid: 31 March 2020
    Are you on arrangement: £1 per month (stopped)
    Status: Default not showing on CRA
    Account owner: Intrum

    Hi all, I sent a CCA request to intrum on the 19/02/20, letter was received next day and postal order cashed a day later, letter wasn't acknowledged but now 6 weeks later (08/04/20), they have sent me 69 pages of account information, then also goes on to say.

    'further to your request for a copy of the original credit agreement, please be advised that we are unable to provide this documentation.'
    do I read 'unable to provide this documentation' as they cannot get hold of it (YET), or simply as its unavailable, as in permanently.
    I've cancelled this months payment, as hoping to offer 5% in a couple of months or so to clear account.

    Keep that letter very safe!
    This is UE whilst that CCA request is outstanding.

    The AAD response is sit on your hands NO communication nothing which restarts the Statute Bar clock.
    Intrum have brought a Bad Debt for pennies in the Pound shame that its turned out to be worthless isn't it?

    If you have surplus monies I would give them to deserving Charity's at this economically difficult time.

      Thank you Roger, I have a second account also with Inrum regarding Lloyds, I gather this is heading in much the same direction then,
      CCA request on 19/02/20, letter dated 18/03/20 saying they are still waiting for the credit agreement, a month later, no updates, other than new offers to repay.
      Unfortunately I dont have any surplus money, is that even such a thing lol, i had to borrow £20 to topup electric meter.

        Those letters are great news, as Roger said keep them safe. They cannot enforce in court whilst they are in default of supplying an enforceable agreement however they can still try and get you to pay.

          Ok many thanks, so will they ever tell me its UE after they realise my monthly payments have stopped, also,
          what would be the next letter i should be responding too, or will they just return it back to the OC to give to another DCA.

            INTRUM I believe may have issues with FCA which is worth noting (for your own records)
            The AAD way after S77/78 requests is SILENCE. You do not need to tell INTRUM anything just cancel payments. They will probably pester you!!! but ignore everything from now on. The rule is everything in writing (no SMS, Txt, Phonecalls).
            Post anything you receive up here in your Diary.

            Now Intrum have more problems here than you AND your Elec BILL is far more important than these leeches.

                Never contact them or reply to anything until you have come here for guidance! They have been known to embroider the truth and AAD has a successful system that helps you and saves you for admitting anything or make errors that may come back on you.

                  Approx balance: £1,819
                  Date last paid: 31 March 2020
                  Are you on arrangement: £1 per month (stopped)
                  Status: CRA says last updated 18/12/14
                  Account owner: Intrum (Nov '14)

                  CCA Requested 19/02/20, 18/03/20 letter saying they're still Awaiting CCA, no update in a month other than offer to pay by installments.
                  Can they alter the default date from Dec'14 tho, because it would be easier to continue to pay my £1 per month until Jan 2021 i guess.

                  I do appreciate those that have offered help and advice...

                    If the default was registered on your CRA file as 2014 then that date stays , no matter who owns it,

                    The default runs for 6 years from the date stated on your file (5 scotland), it will then come off your file weather you have cleared the amount owing or not.
                    It doesn't matter if you continue paying the £1.00, there can only be one default per debt, so if you stop paying they cannot add another default

                        The Default will automatically (or should be ) removed at the CRA's as Nightwatch says above and cannot be reissued for the same debt.

                        However the £1.00 a month payment keeps the 6 year limitation clock ticking so the creditor, in this case Intrum can keep pursuing you for it indefinitely. They are not authorized by the FCA to exercise the rights of a lender (i.e issuing proceedings - though it is a complex legal argument to which unauthorized creditors try and raise counter arguments) but they can use their 'servicer agents' to chase for payment.

                          I have been paying INTRUM for over 4.5 years now (last 4 years at £1 per month)
                          Just a thought, that it could possibly be easier to pay for another 8 months at £1 to avoid the leeches being crafty and resetting defaults date.
                          I realise that i could sit on my hands now, for the next 6 years, Re not paying them, but would rather borrow £600 from my sister and,
                          offer a 5% F+F settlement on both my accounts, im sure they would prefer to accept offer as apposed to returning debt to OC or another DCA,
                          Or would they be refunded their purchase price for the debt they originally payed them.

                            Understand that IF there is an issue with Intrum (see @Jo's wonderful contribution!!) then how can INTRUM pass a good title onto another DCA?
                            THEY CANOT RESET A DEFAULT DATE!

                            There are two Dates here
                            1/ Your Credit Report Date which is 6 years plus 1 month. After which it falls off your Credit Report!
                            2/ Statute Bar Date which is being reset to 6 years plus 1 month after each £1 payment.

                            Negotiate? Well its playing Poker isn't it!

                            The weak hand is you approaching them BINGO they will still fleece you for whatever they think you Might Pay!
                            HOWEVER
                            If STOP paying them (strong hand)! Let them initiate Offers (that is begging for crusts on bad debts)

                            So it comes back again doesn't it to SILENCE and SITTING on your HANDS from a strong position which is the AAD way!

                              Hi Roger, i had assumed that if Intrum gave up chasing debts on accounts because of it being UE, then they would return it back to Lloyds / Hsbc,
                              who would in turn ship it out to another Debt Collector. I have seen elsewhere online about accounts being sold / transferred again while in Dispute,
                              then there's also the thought regarding the actual CCA being found (unlikely, I HOPE).
                              So many different thoughts going around my head.
