    Aka - mrs 5corpio can't claim any money from the loan interest. when she had taken out the loan in 2008

      If she was in arrears and/or had default charges applied then yes she may be able to claim charges and interest back.

      The reason the loan was mentioned is because if you never had a loan you wouldn't ever get a notice that could be faulty and therefore have charges/interest added when technically they shouldn't have been.

              yup, if i were to read the Telegraph front to back, i wouldn't know what was on the first page by the time i go to the beginning again if i were to read. simplified is an easier answer

              suppose this would make it an answerable question as:
              basic QUESTION IS - based on if someone been issued/served statutory notices some or all of the s.77A, s.86B, s.86D or s.86E on a Barclay Loan.

              In this indication that mrs 5corpio never had in the first place been served a Notice = is irrelevant to this thread

                  been served what? she not been defaulted, has no statutory Notice served on her loan as its been paid back in full in the agreed 36 month time, she only has the original agreement (interest charge, loan amount) and with the T&C

                  must be missing something on thread request

                    Ok everyone calm down.

                    A statutory notice is like a default sums notice. You MUST have had one. "we're charging you £x and also x% interest" etc etc

                        A spokesman described the problem, which relates to arrears notices and statements, as "technical documentary errors".

                            Non Defaulted Accounts - you MUST be issued an annual statement. It's these that are wrong

                            Defaulted / Accounts in arrears - you MUST be issued a notice of default sums. It's these that are wrong
