    NO! Do not give in - what you do now is formally complain to the ICO about this ---> http://www.ico.gov.uk/complaints/data_protection.aspx

    You be citing failure to respond correctly to a s.7 request when the lender has been previously satisfied you are who you say you are by sending sensitive data to you in the past etc.....

    Simply write to HSBC and say "I've formally complained to the ICO, copy attached" and attach a brief copy of what you've complained about.

    Basically use the following as your argument to both the ICO and HSBC:

    Because you're stating that you need my signature, in essence to prove who I am; my first port of call will be to question your integrity because it appears you've been sending sensitive data, including statements to this address for some time now. Obviously if you're that unsure of my identity now, I do have to question why a signature request was not made before you sent me each statement, or prior to each other correspondence sent? Surely you can see where i'm going with this and also see that you're going to lose if you continue with this belligerence.

    For the final time, i'd like to draw your attention to the fact that the Consumer Credit Act 1974 does not require that i supply you a copy of my signature. If it is for Data Protection purposes then i can supply you with documentation to substantiate my identity to you. However, to date you have happily sent statements and correspondence containing extensive sensitive private information to the same address and so I have to ask, if you are so concerned that you are corresponding with the correct person why has it taken you so long to raise this? Please answer this point in your reply, i'd like to know why.

    As you are aware, disclosing data without adequate checks of identity is contrary to the 7th principal of Data Protection, listed in schedule 1 of the Data protection Act 1998. I note that there is no provision that removes the requirements of the act to provide this information on time, even if you are unsure of my identity.

      Hiya - was reading Pheonix's diary earlier & noticed the name Newmans(Amex) mentioned...read a bit further back & I think I have just had the same letter from them(also re Amex),in response to a refusal to accept UE and stop harrassing me letter.
      They say that they are in no doubt that the debt is genuinely owed by me etc etc,I have spent a significant amount of money on the card etc,they reject that their behaviour has been anything other than reasonable etc...ohhh & pay up in 7 days.
      They also quote OFT guidance and that this is for genuinely disputed debt not wont pay's and that if I genuineley believe that the debt is not owed to them please let them know whom I owe the debt too.
      But no threat of legals...but they have said in a previous letter that they have authorisation from the client to commence proceedings.
      Do I ignore this one for now?

        Yep as per Phoenix, ignore it.

            Update 6-10-10

            Letter received from PLR re M&S card in rsponse to my last letter (refusal to accept UE / harrassing me or I will report you letter)...
            Please ring us urgently 'we need to talk to you before we act on the contents of your letter....it is vital that you telephone in response to this letter, as action to recover any outstandig payment will continue until we have spoken to you.Obviously,given the fact that you have contacted us, we would rather that this did not happen.I must advise you,however, that we are unable to enter into any further correspondence regarding the exact contents of your letter and this is why you must telephone us. We look forward to hearing from you within the next 5 days'

            Ignore or write backasking what part of 'I will only correspond in writing ' do they not understand.

                      Evening all.
                      Recieved a letter from Citi yesterday containing what they consider to be a 'true copy of my agreement with them'.

                      In reality it is just,as they say in their letter,a copy of the original T&C's and current T&C's - not a signature or date in sight.
                      Not a bad effort considering it took them almost 3 months(since I first CCA'd em) to come up with them.
                      I will send em the T&C's received template.

                      They also wrote to me under seperate cover thanking me for my complaint but they are not upholding it....lol.
                      Not suprised by that answer - but I dont get how they can ring in the evening leave messages on my employers answer machine & then actually call the call out number (for emergencies only) and leave a message with the call out handling service that I must contact them.
                      This was then relayed on to the on call engineer who called his manager , which resulted in me being called into the office the following day.
                      Surely I can take this up with someone - any ideas?

                      Also received a letter(another) from Albion -written by the same mutant (Matt Ball 1 ) threatening yet another home visit.
                      This is getting on my :boobs1 now - please may I ring him and ask him if he is illiterate?
                      He must be because I have written to him on a number of occassions stating that I will only correspond in writing & that I do not give them permission to visit me at home.

                        Hiya, yea ring him and have a go at him - it may be best! Start, by saying this call is being recorded because you're doing a documentary about your life and also mention that if he wants to come he formally accepts your invite to appear in your production that is aimed at the shoddy tactics of DCA's and their appointed representatives...

                        Me thinks he may have second thoughts about ever calling at your home....

                            Citi - spot on, sorry forgot to answer that one....

                            Basically play with the bailiff idiots head and make him believe you're a CH4 producer making a documentary - LOL - he will never risk coming if you say on a recorded call that he formally accepts your invite to appear on the programme if he ever calls at your house as you have live filming at all times.... hehe
