      Well done Matty,

      Congratulations.....

Your diary was one of the first ones I read and began to follow and got hope and inspiration from when I first started out on my own UE journey back in Oct 2010 (as well as Niddy - of course ).

      Well pleased for you

MBNA Visa - Deemed UE - Not paid since July 2010

Latest crew to pick up this were Rockwellback in early April.
Sent 'em the 'sold in dispute ' template to which the have responded with another copy of the application form(dated 1995),signed by me as previously sent by others.
They say that they have satisfied their obligation under section 77 and will not be entering into any further correspondence with me regarding the provision of copy agreements.

I will send 'em the next template on the list - 'Application form received' and see what comes from that.

LTSB Mastercard Deemed UE - Not paid since July 2010

Letter received from APEX in response to my 'Reconstituted agreement' template,re-itterating LTSB's position that the information previously supplied by them satisfies my CCA request -Quoting Carey v HSBC - Blah , blah, blaaahhhh.

What LTSB have supplied to date is a copy of a generic CC agreement and T&C's - no signatures or dates etc,its not even on letter headed paper!.

I will send 'em the 'refusal to accept UE' template and see what comes from that.

                Cheers,

                Matty
                LTSB Mastercard

My mates over at APEX have replied to my 'refusal to accept UE' template , saying that LTSB have complied fully with my request and that the account is enforceable - Bollocks !

Not sure what to send em now - ' enough is enough' template I guess ?
                Or maybe ignore?

I am tempted to simply throw down the gaunlet and ask them why after 2 years and umpteen DCAs chasing the account have they now decided that it is enforceable.
If it is enforceable - it always was enforeceable , so bring it on and take me to court.... but maybe this is pushing it a bit.

Hi Matty, I know it is easy to reach the point with these muppets where you want to goad them, but if it was me in your position I would just send the " enough is enough" template, and let them worry about what move they can make next in an attempt to break you into submission.
                  Good luck matey

                          MBNA Visa

Rockwell have sent word back that they have closed their files as they are no longer instructed to act on this matter.
We will see who picks this up next.

                          LTSB Mastercard

Apex have written back , despite their previous claims that I am 'bang to rights' informing me that they may be able to offer me a subsatntial discount on my balance.....erm......not at the moment thanks.

                          Cheers all,

LTSB MCard - UE & not paid since July 2010
Apex (latest DCA) have written back further to my letter (sold in dispute & addressed to the complaints manager) confirming that they are conducting a thorough investigation and will contact me again once complete....Lol.

Halifax VCard - UE & not paid since July 2010
Iqor have now picked up this - will send 'em the sold in dispute template & tell them how many DCA's have gone before them.

M&S MCard - Enforceabe & not paid since July 2010

I am trying to do F&F settlement with this but was unhappy with their last letter as it only said partial settlement etc.

They have confirmed that the rest of the balance will be written off and the account will be closed down.

Does this mean that they cant pass it on / sell it on to someone else to chase?

Am I being physco here ? - I want to settle and be done with this BUT dont want someone else coming after me for the balance in the future.

MBNA MCard - UE & not paid since July 2010
Moorcroft (latest DCA) have written back further to my letter (sold in dispute & addressed to the complaints manager) confirming that they are conducting a thorough investigation and will contact me again once complete....Long letter in which they go on to challenge the statements in my letter to them re CCA unforceability and quoting OFT guidlines etc etc.
I will see what they come up with.

                            Matty

Response recieved from Arrow Global enclosing a copy of the original acceptance form , signed and dated along with T&C's and informing me to deal with Moorcroft..

What they have negleted to do is answer my last letter regarding the unfinished PPI business, most probably because they know they have nowhere to go with it.......so, I will leave this one for now.

                            Cheers all,

                            Matty

                              And on it goes....

MBNA - Deemed UE by Niddy & not paid since July 10.

This has been round the houses a bit - now with Moorcroft on behalf of Arrow Global.

In response to my last letter - Application form received - They have sent me a copy of my signed acceptance form saying that they have now answered all my concerns etc etc.

They have put my account on hols for a further 28 days to allow me to respond.

Any ideas what / how I should respond to this or I am stuffed?

LTSB - Deemed UE by Niddy & not paid since July 10.

Letter recieved from HL Solicitors on behalf of Apex credit - advising me of legal action if I do not pay up in full within the next 7 days (letter dated 25th & received today the 30th)

Has any one had any dealings with this lot?

Not sure how to respond to this - other than the threat of legal action templated ,but it wont get there in time unless I send it SD.

This account has also 'sone the rounds' - in response to all my previous CCA requests all that has ever been sent is some very plain (not even on a letter head') T&C's and an agreement. No application form,no signature.

Any pointers would be much appreciated as always.

Halifax VCard - UE & not paid since July 2010

No response from Iqor to date further to my 'sold in dispute ' letter

M&S MCard - Enforceabe & not paid since July 2010

Settled - F&F agreed and paid. Letter received from M&S confirming all sorted - will keep this safe.

                              Kind regards to all,

                              Matty
