    Date the letter too mate with 9th May on it
    I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

    If you spot any spammers, AE's, abusive or libellous posts or anything else that just doesn't feel right then please report them to me as soon as you spot them at: webmaster@all-about-debt.co.uk

        And just remember to keep smirking through all this because M & S don't even know yet that Mrs MattyA has a storecard which was "upgraded" unlawfully into a credit card

              Ah ha! I was going to photocopy my "Dear Madam" letter from Midland Bank to me and give it to DrowningNotWaving on a just-in-case-basis for the same reason

                Morning all - Just a quick update:


                After a couple of quiet weeks,it appears the vultures are gathering again......will have to get the shotgun out again.


                MBNA Visa - Deemed UE - Not paid since July 2010

                Latest crew to pick up this were Rockwellback in early April.
                Sent 'em the 'sold in dispute ' template to which the have responded with another copy of the application form(dated 1995),signed by me as previously sent by others.
                They say that they have satisfied their obligation under section 77 and will not be entering into any further correspondence with me regarding the provision of copy agreements.

                I will send 'em the next template on the list - 'Application form received' and see what comes from that.


                LTSB Mastercard Deemed UE - Not paid since July 2010

                Letter received from APEX in response to my 'Reconstituted agreement' template,re-itterating LTSB's position that the information previously supplied by them satisfies my CCA request -Quoting Carey v HSBC - Blah , blah, blaaahhhh.


                What LTSB have supplied to date is a copy of a generic CC agreement and T&C's - no signatures or dates etc,its not even on letter headed paper!.


                I will send 'em the 'refusal to accept UE' template and see what comes from that.

                  Update on M&S Card F&F

                  Was starting to get a little concerned - letter sent but cheque not cashed 3 weeks later.
                  Letter received today from M&S accepting my offer etc etc - cheque still not cashed.....
                  I am sure it will go through in the next day or two - was begining to think they had rumbled me as I paid em with a HSBC cheque (schoolboy error) and was begining to think they had done an inter company search and had realised that I might be able to pay more than I had offered ....the tricks your mind plays on you.

                  Anyway almost 2 years down the UE path and 60 letters later it seems like this one is done and dusted saying me circa £4K.

                  That is another one off the list and over £20K of my debt wiped out.

                  THANK YOU BOSS FROM THE BOTTOM OF MY HEART.


                  For people just getting involved / following the UE path - This account was ENFORCEABLE but following the Nidship path I have managed to settle the account for approx 1/3rd of the outstanding balance AND I have not made any payments to the account since July 2010 saying me circa £3K.

                  Dont be scared of trying it on / blagging it as there is a good chance it will save you a considerable amount of money.

                        Just to clarify this point, these firms that use a bank to handle their agreements, i.e. M&S/HSBC - they are not linked in any other fashion other than to provide the finance to the creditor. So in this case, whatever happens with you & M&S stays between you - HSBC don't know and M&S don't know anything about your HSBC accounts.

                        Similarly, this used to work between RBS/Tesco and HBOS/Sainsbury - too many to sit and list them all but thought it needed clearing up!

                              Well done Matty, well pleased for you mate, you represent what this site is all about - fighting back after years of being screwed by the banks because they kept throwing money at us knowing we could not pay it back and would become slaves their demands and constant interest rate rises until we finally buckled under the pressure.
                              And of course we have our leader Niddy to thank for showing us the path that leads to getting our lives back.
