      I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

          Not heard anything on this for a while (Since MBNA wrote and told me Arrow were now the owners of my account) - i have now received a letter from Moorcroft 'notice of intended litigation' blah blah blah.
          They do not mention which account it is - but I can tell from the balance claimed.
          Will send 'em the 'threat of legal action' template and see what response that prompts.

          Co-op Visa - UE

          In response to the above , I wrote to them acknowledging their letter and reffered them to my previous correspondence(Threat of legal action template) to which I still had not received a response.

          Letter received yesterday informing me that they have ' closed the file' and wont be bothering me again with this one.

          Will wait for the next DCA to pop up all bright eyed & bushy tailed with this crock of sh*t.

                Quick update - it was quite a busy week last week after a few quiteish ones.

                LTSB MCard - UE & not paid since July 2010
                Apex (latest DCA) have written back further to my letter (sold in dispute & addressed to the complaints manager) confirming that they are conducting a thorough investigation and will contact me again once complete....Lol.

                Halifax VCard - UE & not paid since July 2010
                Iqor have now picked up this - will send 'em the sold in dispute template & tell them how many DCA's have gone before them.

                M&S MCard - Enforceabe & not paid since July 2010

                I am trying to do F&F settlement with this but was unhappy with their last letter as it only said partial settlement etc.

                They have confirmed that the rest of the balance will be written off and the account will be closed down.

                Does this mean that they cant pass it on / sell it on to someone else to chase?

                Am I being physco here ? - I want to settle and be done with this BUT dont want someone else coming after me for the balance in the future.

                      I am considering sending the payment with a covering letter (adapted F&F template) to include a paragraph stating that the payment is made in full & final settlement of the account and on the proviso / understanding that the account is closed down / written off by them and that it will not be sold on to a third party......I have already questioned this and they have 'skirted around it' which worries me.

                      I have until next Tuesday to pay them or they will re-apply the balance ( so they say at least) - any ideas ?

                              Hi boss & thanks for dropping by.

                              I d use the template.....


                              'Whilst I am happy with your intimated acceptance of my offer of £xxxx in respect of the outstanding balance on the above account , I am concerned with certain wording used by you in your letter, such as ‘we are prepared accept your offer of £xxxx to part – settle your balance’ and ‘we will now record that the default has been satisfied and your account has been partially settled’.
                              I am fearful that once this payment has been received that you will resume collection activities and / or sell the account on to a Debt Collection agency or other third party, who will then pursue me for the remainder of the balance.

                              In light I confirm that my offer to settle for a single payment of £xxxx still stands and will be made within 7 days of your confirmation of the following:
                              • You accept £xxxx in full & final settlement of this account with no reference or future ability to quote or use Penny v Cole [Pinnel 1602] in trying to recoup any written off balance;
                              • The Status of the account will change from “Defaulted” to “Settled”;
                              • The Current Balance will appear as £0.00;
                              • The Default / Delinquent Balance will be set to £0.00;
                              • You will update the entries on all 3 Credit Reference Agencies, namely Experian, Equifax & Call Credit

                              but they have skirted around the Full & final bit......however they do say say that the account will be 'noted as partially settled' and the remainder of the balance 'will be written off and the account closed down'.

                              Was just wondering how to protect myself / ensuring that I cant be pursued for the remainder of the balance ,when I make they payment.

                              Hope this makes sense.

                                Their letter says....

                                Dear Matty


                                Thank you for your letter ...Blah blahh etc

                                'we are prepared to accept your ofer of £xxxx to part settle your balance.The remaining balance will be written off and your acount will be closed down.'

                                They go on to say...

                                'We have already registered your full balance as a default on your file at the credit reference agencies. We will now record that the default has been part satisfied and your account has been partially settled.This shows that the terms & conditions of your credit agreement have not been fulfilled as you didnt repay all of the money you owed'.

                                Hope this helps you understand my fears that they are leaving the door open (possibly) to come back for more?
