    Hi Niddy - thanks for the above.
    I sent Newmans a copy of the letter you suggest on 19/10/2010(1st class - not special) in response to their previous threat.Their latest letter was dated 22/10/2010 - maybe the letters crossed in the post.
    Do I need to send this again - special delivery as you suggest or wait to see if they respond to my letter?

    I have also recieved a letter from Citi saying that I should have now recieved a copy of my executed agreement and that my complaint is now closed.

    What they did send was photocopies of T&C's no signature etc - to which I responded with the T&C's received template on 19/10/2010 - again I think the letters have crossed in the post, so will file this one for now.

      I'd presume the letters crossed so leave it a week and see what happens.......

      Regards to citi, just ignore them.

          Hi Niddy,

          Got a letter from Power2contact in response to my complaint(s) about doorstep visits - nothing sinister in it but they are quoting the law back at me and I would love to send something back ...no rush though.

          They say
          1: 'in relation to feild visits in subsection 2.12 of the OFT guidelines,doorsteps visits must give adequate notice of the time & date of the visit' - They have never done this ,in fact I am sure they post their letters warning of intended visists 2nd class & time so that they arrive on they day of the proposed visit giving you no time to respond.
          2: 'The Armstrong v Sheppard case quoted is dependant on each individual circumstance and only such order to refuse access can come from a court and NOT from an individual.

          Any words of advice on how to respond to this would be appreciated as I feel sure they are wrong or at best twisting the guidelines / law to suit - but no rush.....I note you were still up/on here at 4.53am this morning!

            Don't worry about it mate - its not worth my time nor the effort in replying, point is when / if they send someone round then you simply print some of these and hand one to each person that calls...

            If they get snotty, and send someone after you've issued one of those then you start with the more formal legal threat of Injunctive Relief Order ---> viewtopic.php?p=183#p183

            If you've already sent that, not much more you can threaten.....

                15 letter receievd over the past couple of days - same old same old ring us now or else,which I will ignore for now.

                one of the letters from Newmans re Bcard accounts 'special offer' they will pay 15% of my outstanding balance,therefore I only have to pay 85% - but I must act quickly.... ;Hmm

                        I have had a letter from M&S (enforceable) Final Demand - must pay in 48hrs etc or will pass on to DCA who may visit my home or commence proceedings via the county court to recover the debt and that I will be responsible for all associated costs ;EEK .


                        I assume that I wait until I hear from whoever and that I will get notice of court proceedings?

                        At what point do I need to start talking to them re payment plans / settlement?


                        Long letter also received from BCard in response to a complaint re harrassment by both them & Mercers.
                        They state they have done nothing wrong,that they believe the account is enforceable,I must pay,blah blah.
                        I assume this just gets filed with the rest ,just thought Id check as it soooo long.....

                            Ermmmm - I always made it clear to make sure you're not linked within any banking organisation and I thought you'd know that M&S, GM, Sony etc use HSBC - lol. Anyway, time to change banks asap - but you'll struggle for full banking now cos your credit file will be trashed - you should have done this on day 1 - as Pixie/Ann etc have done.....

                            Anyway, too late worrying now. You get 14 days after being served papers, but again, its easy to sort - you can contact the DCA etc and arrange to settle by monthly instalments at any time.

                              Ahh well - Im at where Im at for now & fight on I must.
                              Hopefully others will learn from my mistakes.....no one said this was going to be easy.
                              Full banking - not sure what you mean by that - all I want is a bill paying account for now to pay my wages into & mortgage and other bills through.
                              Any ideas?
