      Full Payment: Unsure at this time. Last reduced payment - September 2010

      Paying - No
      Default: 26/06/2004 - £5601

      29/07/2010: sent CCA request to Wescot
      03/08/2010: received letter from Wescot claiming to not be creditor.
      17/08/2013: received letter from Marlin Financial Services requesting contact with them.
      19/08/2013: sent CCA request to Marlin Financial Services.
      24/08/2013: received letter from Marlin Financial Services.
      17/09/2013: received letter from Marlin Financial Services with copy of Online Application.
      23/09/2013: received letter from Marlin Capital Europe.
      04/10/2013: received letter from Marlin Financial Services with copy of original T&C's

      Hi fellow AAD Peeps

      Hope this finds you all well. I have had the pleasure of another letter from Marlin following up on my CCA request. Previously I received a 'copy' of the online application transcript and now I have been sent a copy of the T&C's.

      The letter reads:
      "We refer to your recent request for a copy of your Agreement. We have enclosed a copy of the document from the original creditor for your reference.
      We are still awaiting a copy of the Statement of Account and will forward to you upon receipt.
      ...Usual blah blah blah"

      Now what I am finding a little curious is the fact that they still haven't sent me anything with a signature or 'something else' to indicate I accepted the agreement. I would really appreciate some clarification whether what I am receiving can constitute an enforceable agreement or not. Happy to scan and send what I've been sent if it helps

        Nothing much to report, just received the Statement of Account from Marlin. Funny thing is that they are chasing something that doesn't even exist on my Credit File anymore. Waiting for end of June when the final thing disappears from my file and then I can start building my rating back up ... yippee

            It's going to be fantastic knowing none are on my CF. I realise they 'still exist' and I need to wait a couple more years for them to be SB but it should hopefully give me the opportunity to start repairing the damage.

            Any tips on easy ways to give your rating a boost after getting it cleared?

                Hi All,

                Hope everyone is enjoying this sunny weather and it's acting as a good distraction if you are still having credit/financial hassles. I've not heard from any of mine, apart from a statement, since October and having checked a Credit report I got a few years ago then I should now be all clear of Defaults!!!! The last one, Paragon (Arrow/Transcom etc) was defaulted on 10/06/2008 and so should now be clear from my file. The others all defaulted in 2004 or before so came off ages ago.

                Now, what I would like to know is that is it worth getting a fresh copy of my file to make sure it's clear? Would it be too soon to get a credit card (to pay for diesel and then clear at the end of the month) to help boost my score? I am asking because I am hoping to move house later this year and obviously could do with a half decent file to help, though we have got lots of equity and cash as a deposit.

                Any guidance would be appreciated. I have checked out http://forums.all-about-debt.co.uk/s...4046#post54046 already and have always maintained a normal bank account and had a mobile phone through all my financial problems.

                  OK. NOT HAPPY!!!! (apologies for shouting)

                  I requested my Credit File last week and finally for the code to check it online and have done so. I was expecting to see none of my unenforceable debts on it, leaving it clear and fine for me to proceed with moving house etc. Anyway, I had an Egg card which defaulted in 2004 and so should be clear from my file. However, the debt is now under Marlin and it seems to have been "re-defaulted" in 2011. Now Marlin didn't own the debt in 2011, Wescott did. What I want to know is how can the debt be defaulted again??? All my other debts, including the one I have been waiting to get shot of, have all disappeared but this one is lurking on there.

                    As far as I'm aware, you can only get one default per debt. I would get in touch with the CRA.

                      Yes get in touch with the CRA, it appears wescot prob changed the default date, and when marlin bought it, then just added the same date to their entry.

                          I don't think there's a template for this. Why not have a look in the defaults section of the forum and see if you can find anything? (There is a custom template in the templates section but it's for a SB debt)

                            Thanks for your help regarding the Defaults. I have had a thread going on there and am getting the results needed in that Marlin Financial have agreed for the default to be removed.

                            What I am wondering is, they have asked for money in the past but I challenged claiming that it's unenforceable as neither they or Wescott have managed to provide the original credit agreement. Additionally they have now agreed to have an incorrect default removed. Does this mean they may have given in and realised that they have no chance of getting anything out of me??? Given their reputation, I have had very little hassle or problems from them.

                              Who knows with DCAs

                              Marlin have one of my accounts and all I get are statements every six months and a letter saying that it isn't a request for payment.

                              I wouldn't worry about it. Just let us know if they start hassling you.

                                Well I too only get an occasional (6 monthly or yearly) statement saying what the debt is and it's not a request and I only get this from Marlin. All the others I haven't heard from for a long time.

                                Extra good news is that Experian and Equifax have both removed Marlin now and checking my details via Noddle, everything is green and looking good and they rate me 4/5 (I know this is a subjective and almost irrelevant figure). Time to finally start moving on and hope that they all just forget I ever existed LOL
