    28-02-11 Letter received from Greens Solicitors demanding I pay Triton Credit the outstanding amounts owed.
    Responded with account in dispute letter as per niddy's instructions.
    Letter received from RBS - "We do not consider this account to be in dispute as we have fully complied with your request under the Consumer Credit Act s78, and our position remains as advised, your indebtedness remains due and we will be pursuing for full repayment. This is our final response. If you remain dissatisfied you may refer your complaint to the Financial Ombusdsman Service."

    I'm thinking File for now and await their next move?

    All you do is a send a one liner to Greens saying "see attached my previous letter to Triton, which outlines my position. I suggest you return this account to them as any action attempted by you will be met with a full defence as unlawful and vexatious with a full counterclaim for quantifiable damages and all costs. I further suggest you speak to Triton and explain the law to them, in particular that they are forbidden from passing on a disputed account, especially to an internal legal arm of the bank and if it happens again, legal action will be commenced against them"

    Then attach a copy of the threat you sent Triton at the beginning of the month.

    NB: I notice Triton Credit Services and Greens Solicitors are trading names of RBS, so no doubt just another ploy by the bank to mislead customers by using different trading titles to confuse people with their scare tactics. (another unethical thing "Greens" do - They use window type address envolopes and fold the letter to make the word Solicitors in Bold type clearly visible in the envolope window !) obviously to upset the addressee who may be worried that other people may see the letter..I first noticed this folding the letter tactic on another letter I received from Greens a while back in relation to my UE RBS/Mint account.

    1. No Prescribed Terms
    2. The terms they sent are recent - not from 1996
    3. The "original terms" are dubious, to say the least but are not part of the signature page in any case

    Letter from Triton - Quote " [size=5]Our records confirm that RBS (Mint card) issued a full response to your request under section 78 of the CCA act. and enclosed all the relevent documention. Finally on 2nd September they issued a "final response" confirming they had met their obligation uinder the CCA act.
    Therefore if you do not comply with payment it will leave us no alternative but to commence further action against you without further warning or delay " Unquote

    Have they signed for your last letter yet? I suspect they have crossed in post/filing system so just ignore for moment.

    RBS have sent what they say is a copy of my CCA, but it is nothing more than 5 pages of T&C, there is nothing on the "agreement" signed by me or RBS.

    Responded with only "Termas & Conditions Supplied" template
