I would be looking to send a letter for them to sign agreeing to the F&F, unless they have already confirmed in writing, in which case your letter would state please find enclosed cheque for £500 in F&F settlement of the full outstanding balance on account No xxxxxxxxxxx and as agreed to by yourselves in your letter dated xxxxxxxxxxxx

Morning everyone.. success.. Scabhunter you are a GENIUS!
I have had a reply from Marlin saying they have had a chance to consider my letter and the matters therein are best answered by their solicitors but they are willing to accept £500 in full and final settlement of the debt.
I then got a letter from MCL saying the letters were not fabricated, they were definately sent and they see that I did not receive them and it may be they went astray in the post. Their client wishes to move this forward and has instructed them to accept £500 in full and final provided the payment is made within the next 3 months. The matter has been placed on hold pending the payment.
I will get them paid within the next month.. want them out of my hair!!
So then.. do I need to respond or just leave it until I send the money and do I need to send a special letter with the money? Also, do I still report them (MCL) for lying about the letters?

Yes, MCL/Marlin are scum, but hopefully they will now be more scared of you than you are of them. Especially as a FOS mediation fee will leave them needing to accept your £500 just to get out with a break even result.

Well, there isn't a great deal of difference between £6 and £5.79 (or five pounds, fifteen shillings and nine point six pence of genuine British currency), is there?

Ive done that, put all the debt in there. I just forgot stuff like window cleaner but it still came out at just £6 a month. If Jane hadnt mentioned putting it in I wouldnt have thought to do it! That's probably why my CCJ payments were set at £1 per month. At my age, I'll probably be dead before they even get their court costs paid
Will just sit back now and see what the next letter brings. Im just a bit scared of MCL I think because of all the scary stories Ive heard about them .. claws will be at the ready though haha

When you're doing an I & E form you have to include all debt, even those which are UE, so that you're not seen as favouring one particular creditor.
That's probably why my CCJ payments were set at £1 per month. At my age, I'll probably be dead before they even get their court costs paid

Yes your right and the image of a wobbling bear made me literally laugh out loud haha! Ive done the I&E and I was almost spot on with my offer of £5.79 so I feel loads better now!

Its done!!! It works out that pro rata the MCL vultures could have £6.00 a month so my offer of £5.79 wasnt a million miles away. Also there are probably things I could have put in the I&E form .. like window cleaner and house maintenance which I havent.
