Re: Oscars Natwest UE Diary.
Well, Well, Well.
Looks like I am about to start again.
Wescott have just called regards this, so after informing him of the serious dispute, the previous DCA, he said he will contact NW and get them to forward all the info!! - good luck.
Oh, and also, Wescott have not "bought" the debt, but are "employed" by Natwest for its recovery.
Can I assume Natwest are as uselful as Lowells?
EDIT 21.00!! Natwest?? I meant WescottLast edited by oscar; 21 July 2011, 20:02.I'm an official AAD Moderator and also a volunteer, here to help make the forum run smoothly. Re: Oscars Natwest UE Diary.
Update:
Wescot have written (been a while) saying Natwest have confirmed if I want anything else I need to write to them directly. So the Enough is Enough letter is going off. Afterall this has been going on for nearly two years and is three since my original CCA request.
Didnt see the above previously Niddy. You know me, I like to talk to these idiots and quote facts and figures and generally take the piddle out of them. Havent spoken to them probably since the above and an getting boreed playing games with them - keeping it to writing now!I'm an official AAD Moderator and also a volunteer, here to help make the forum run smoothly. Re: Oscars Natwest UE Diary.
Ok, at Wescot advice (as above) wrote to NatPest with the Enough template.
Response came about two weeks ago (been holding off as boss on Hols).
Anyway, a breakdown of letter.
...under s78... provide a true copy of the agreement relevant to the product on the date made, plus copies of terms of the product. These should be accompanied by statement of account.
When responding, we are complaint if we provide a true copy in accordance with.... regs 1983. This means there is no obligation to provide original with sigs. True copy does not need to contain personal info
We have supplied a copy of the credit agreement, after which you recieved your card. We also supplied a copy of the original and current terms and conditions of that crad product with the prescribed terms and a statement showing the outstanding balance. ....... we have met out s78 obligations.
blah blah blah - we see no reason to enter into further correspondence....
blah blah blah.
I suggest you take advice from CAB or similar if you continue to doubt what we have told you.
This was quickly followed by a letter from Wescot saying they have confirmed I am still resident at my address but they have not recieved a reply to previous corres. Strange that. I also have letters from them stating "Thank you for your letter...."
Anyway, long story short. Keep ignoring?I'm an official AAD Moderator and also a volunteer, here to help make the forum run smoothly. Any views or opinions are mine and not the official line of AAD. Why not use our new stuff, try the CPUTR version of attack mate...
Originally posted by PriorityOne View PostDear Sir/Madam,
Your Ref: xxxxxxx
This is a formal request under the Consumer Protection From Unfair Trading Regulations (CPUTR) 2008.
I require your organisation to provide written confirmation that states clearly whether you currently hold an original signed Consumer Credit Agreement, or whether you do not hold an original signed Consumer Credit Agreement pertaining to myself.
For the avoidance of doubt, an original signed Consumer Credit Agreement is just that; not an application for credit and not a reconstructed or microfiched document from other sources.
Please note that until such times as a legally enforceable, original Consumer Credit Agreement can be produced and a copy sent to me by return, then this letter is not an acknowledgement of debt.
Please also note that failure to provide a direct answer to this request will be brought before the court, should you decide to defy the content of this letter and instruct solicitors to pursue enforcement action regardless.
Yours faithfully,
