    Well that didn't hold them back for long..... court papers received for M&S (enforceable). ;P-;

    Any advice? Do i use the papers received to make reduced payment offer, or should I contact them direct? I assume whatever I do I do it in writing only. They added solicitor and court costs, do I accept these added to the debt?

    I would like to make a token payment, but I guess I need to be more realistic - hoe tight are they on this? I think I'll use the CCCS forms from to plan my outgoings again, its helpful working out the maximums that are reasonable for each outgoing - I would include other CC payments even though i not paying them ;Sh .

    Would they ever need to see a bank statement? Whatever I guess this is something to deal with this week.

      aaah bollocks mate - is it definitelty the N1 claim form from the central bulk processing at Northampton?

      Sorry to hear that mate..... Do you own your own house and/or need a clean credit file for work? i.e. i'm thinking you could just ignore it all...... but only in extreme circumstances. (I never said that honest)....

        ....yeah, I own my own house so no escaping paying really - yes its the form from Northampton bulk as well. All legit..... Its a card I want to do a F&F offer on later next year when I get a small payout, so I was hoping to knock it about a bit till then.

        Fair play to them, no messing around - I must of missed my first payment not even 8 months ago after being a perfect payer since I got it? No selling it on and dragging it out for M&S! ;F-

            Hey NID, thanks for you usual quick replies!

            ....Well, interesting. Let me think about that for the weekend, mull it over. What does defending involve, and what am I defending on? I didn't even see an option down that crazy route.... Its enforceable so what am I trying on? Is it even possible to get a positive outcome?

                Bugger, it still is enforceable i'm afraid - what a bugger!! Basically linked, look in bottom right corner at code and linkage (page 1 of 2 and page 2 of 2) - bummer.

                I'd probably ring them and ask them if you can arrange repayments and see what they say.... sorry, we tried matey.

                  Just quickly:
                  So you'd recommend phone instead of using the offer/budget form that comes with court papers? What happens? If I offer 10 quid a month are they going to laugh at me and ask for proof of budget and refuse and say we'll take you to court anyway? I dont want to F this up, or give them any unnecessary info or ammo.

                    Hiya

                    What you got to realise is that the court will always offer a proportionate amount whereas the lender/dca will want anything you have left (i.e. higher amounts) - but that said, i'd be looking to make a sensible offer to stave off court action then consider reducing it in a month or two....

                    I'd suggest you ring them and ask them if you can set-up payment proposals.... or you ignore them and let them CCJ you, other than that they still can't get blood out of a stone can they? A ccj lasts the same 6yrs as a default.

                    I am not suggesting you do this, but put another way, I know a lot (I mean hundreds) of people who'm i've helped that have CCJ's and have never heard back once they "vanish from the face of the earth" lol ;-)

                      Quick EGG update:

                      letter received - we are canceling your account and passing on to a DCA.
                      ....about time, no action needed by me at this point. Will update when I see who they've given it to.


                      M&S - Thanks Sir NID, interesting stuff as usual! but as I own my own house and have various assets (well, stuff) Im concerned if I just treat this as another "default" they can go after this. PM me if we are going into a slightly legal grey area :xmas9
                      ...I would be happy to take a CCJ if that's all it was, as I'm still awaiting one lazy CC to default me anyway, so I'm not doing anything creditwise for the next 6 years anyway.

                      ....Im going to do a bit of research on this aspect myself today I think, as I feel like Im hassling you a bit on this one point, sorry if so mate!

                        ....well, I just did my cccs budget again and it says I have only a quid left over to offer all my creditors ;30

                        ....all costs I have added are within CCCS guidelines and nothing should jump out. Would this put me in a good position to, say, offer M&S a tenner a month to drop the court proceedings and send them my budget that shows that I'm being quite generous and they might get nowt in court? Personally I think I could go to 20quid on this debt that is around the 7k mark - or am I being naively low with this offer?

                            I am watching your progress with great interest slug.....I am in a very similar position but have not had the court papers yet.
                            I have also done the CCCS thing & it came out at 16 years!
                            So like you there is little left each month for the various creditors.
                            As his nidship says,give it a go and see what happens...I will no doubt end up folowing suit.

                              Listen you guys don't go worrying, a lender will only force action if they are 100% certain it is enforceable - so those of you that have managed to stave HSBC (M&S) off for a few months will already know that they are not certain otherwise they'd have tried to take action......

                              Who knows maybe they have been "ill" advised to bully the issue to get results, all we need though is for them to do it to someone from legal beagles/cag who will defend it - then we get a test case scenario which isn't a bad thing (at times) so long as arsehole waksman isn't presiding the case! If so then it'll be another lender victory in the face of the consumer and the acts set-up to protect the consumer from this exact bull shit from occuring.

                                Hey Y'all,

                                well I haven't got in touch with the Solicitors yet to make an offer but they did send me a new letter. I presume this is their response to the letter I sent asking them to leave me alone and not take me to court as soon as they first threatened, which it seems they did straight away anyway without reading my letter first.....it says:

                                "Thankyou for your letter the contents which have been noted. Our client has instructed us to issue a claim for a county court judgement. The claim form will be sent to you from the court.
                                We have referred to our client to ask for the information contained in your letter. Once we have responded we will allow a further 14 days from the date of that letter should you wish to file a defence.
                                Should you wish to discuss, call us bla bla bla."

                                .....dont think this changes much (if anything), but I was a little unclear whether they are delaying the court action by 14 days themselves (badly worded that bit)? Maybe I should do that anyway myself through the court papers (delay extra 14 days), before I make an offer, just to see what the outcome of this is first? Might be worth a punt.

                                I still have 7 days to make a response to the court papers so no rush - aware KingNIDs is away till Tuesday and that's fine.
