    Go and have a beer on me - seriously you have just probably saved my Christmas - I was likely to snap at the anything/body the worry I was getting in. And I just watched a perfectly good bottle of RED wine fall off the top of the fridge and down the back. We have a white kitchen floor. Guess the results and my reaction. Swearing was involved.

    As usual I cant thankyou enough yeah! Have a GREAT Christmas!

      The main thing is never panic, remember whatever they throw at you - we've seen it before and may be able to offer some advice. Sorry about the red wine - bloody stuff is worse than having a pet pit-bull at times!

        Just seen your post real sorry to see the court case has happened, as niddy said apply for a re determination it isnt as bad as you may think or you might know already, We have been for a redeter ourselves and they wanted via northampton court £600 the judge we saw was very pleasant even to us peasants and only awarded £105 and no charging order as we said it was unfair on the other creditors.

            Redetermination letter has been sent, and I will update you on any replies I get.

            Interesting to see you get CCJ "trawlers" who now write to you by hand using yellow envelopes to make you open it and not throw away as trash!

                ....I've just got a letter today from D&G Solicitors on behalf of M&S accepting my offer of 10 pounds a month I made before the court date (for 60 years term ).

                Obviously Im happy with this, but I want to make sure I close all legals gaps with regards to the CCJ and that ruling. Do I need to write the courts asking for the ruling to be removed and stop it being enforced (the creditors have agreed to an offer I made to avoid a CCJ)? Or do I wait for them to respond to my redetermination request and respond then? I'm aware i dont want everything to keep crossing and causing more confusion for their simple little minds.

                Either way this is probably as good as I could of hoped for on an enforceable debt in the region of 7k I'd assume.

                  Well done! As you say, it is a result of sorts..... most lenders will accept such offers cos whilst it sounds crap right now, to the lender - you may well be in a position to pay lots more in future..... whether you do or not is a totally different ball game mind

                  As for the CCJ, you just leave it now - if for some weird reason the court issued default by judgment then you'd request set-aside as you'd previously agreed to halt action - which was also accepted by the claimants.

                      03/09/10 - just got a letter form CCA (part of egg) usual guff but with a new bit - your account "may" be forwarded to our specialist customer contact company - Resolve Call: that "may" request one of their contact managers to visit your home address.... I note they have still to default my account despite all this and months of non payment - come on! get on with it!
                      07/09/10 - "dont you think about coming to my house, muppets." letter sent.
                      08/10/10 - Finally! EGG has defaulted me, but it gives me 28 days to pay 1800 arrears before the default is registered with credit ref agencies. It says from 29/10 they will demand full settlement etc, instrunt solicitors or debt collection agency, teminate agreement etc.
                      07/12/10 - Account now with CDUK (a trading style of Improved Financial Solutions Ltd), they have been auto phoning me for about 6 weeks, with the odd real life person. Have now recieved my first threat-o-gram from them. "our client could take court action" etc and so on.
                      11/12/10 - sent letter as advised by NIDs - dont threaten me with leagal action etc
                      16/12/10 - Recieved phone message desputing my legal response above. Also recieved letter from Solicitors to a work address that pre-dates my legal letter above by a few days.
                      05/01/11 - Recieve about 2 missed calls from CDUK a week now, no postal contact recently. Yet to make formal complaint about harrasment at work, but will do as advised.


                      Update on those marvelous EGG people.
                      I've just been handed another letter at work (dated 21/12/10!) from HL Leagal&Collections Solicitors on behalf of CDUK. Same stuff as before I think - pay our client within 7 days of the date on this letter or we will recommend our cleint proceed with legal action etc etc and so on.
                      I DO plan to make a formal complaint about this work based harrasement, but haven't got round to it yet. It is on my to-do list, honest! A little more evidence doesn't hurt.

                      As for this letter - I'm assuming its a case of IGNORE for now.

                      The last I heard from CDUK was a phone message from their legal dept, saying they didn't like the NIDDY legal letter, about mid-December (.....not even any missed calls from them for a few weeks now....).

                        Hiya, can you confirm this just once more for me -- you have a DCA writing to your place of work? Are you the owner/director or just a normal PAYE employee?

                        I'll do you a Niddy special on this.... they're breaking the freakin law the fools

                          Indeed, I am but a small, normal, PAYE employee in a international company that numbers hundreds of employees - it has NOTHING to do with me (wish it did!).

                          The letters are being sent to my work main office down the road, where I dont even work - The sender is a Solicitor writing on behalf of the DCA, they have sent two letter now.

                            Can you please email me the solicitor letters - also, how did they get that address? (was it from account application form?)... Have the DCA/OC been writing to you at home prior to the solicitor involvement, and if so when did they last write to you at home (specifically, did you reply and if so when?)...?

                            * Ok, the law bit - if you can prove that you have not blatantly ignored them then they must not try other avenues (ie work) so we need to establish if you've been contacting / replying to them from home or if you usually ignored them .....

                              I will scan and send - wont have access to a scanner until Wed/Thurs though.

                              How they got my address, interesting! --- deffo NOT from any aplication forms or any info I have given them directly, this account pre-dates my work and I NEVER give out info. But I can tell you exactly where they got it from...

                              Before I started UE or found the original Niddy stuff early last year, I was obviously still in the deep do-do. When I was trying to pay reduced amount to EGG directly myself, before I was in default or had missed many paments, I ONCE phoned from a work internal line in my lunch break (doh!), I thought this line was blocked but it wasn't so EGG must of then saved that number on their database without my knowledge - they then used this this number to call constantly when I defaulted and missed payments. This ceased when I sent them letters as advised by you.

                              Sooooo.... I would assume they have traced the company Name from this phone number ( or someone answered when I wasn't there and they got the name of the company out of them?). A quick Google would give them the main office address, and volia they have somewhere to write to. The solicitors are the first to use this address so I dont know if EGG, the DCA or the Solicitors did the snooping.


                              ...right, your last point about ignoring. I have been in contact with the DCA via post. I think I have sent them, one or maybe two letters. I will check my records. Dont tkae legal action-account in despute type stuff- awaiting CCA from lender. To jog your memory when they recieved my Niddy letter they left me a long phone message saying I obviously dont understand legal stuff and to call them back. I have obviously never spoken to them via the phone, not even to tell them to F off. As far as I can remember without my files in front of me the DCA have only ever sent me one or maybe two letter - the address they have is a mash up of two address so I might not receive more stuff if they have sent it?

                              Hope this is the info you need - will "firm" it up a bit more when I can tomorrow night. Hmmmmm. That sounds a bit rude. *cough*
