    Hiya. I'd just ask them to drop it and you'll agree to an arrangement....

    Pointless really cos it is enforceable...
    I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

    If you spot any spammers, AE's, abusive or libellous posts or anything else that just doesn't feel right then please report them to me as soon as you spot them at: webmaster@all-about-debt.co.uk

      Well I phoned up and tried to make an offer, but seems I've got to wait until I hear back from this:

      ....which should be soon as they managed to find it easy enough last time. When they have resent me those docs I have an extra 14 days to respond - i.e. they have already delayed court proceedings whilst they look into it. If all I've done is give them a bit of annoying paperwork then I guess that's something. 1

      They will then look at an offer via the court admission form, but not via the phone....I guess I could do that now anyway, no real difference, just dragging it out.

      He kept trying to make me admit to owing the full amount on the phone which I avoided as I didn't know where we were going with the conversation. Bit annoyed they've got my mobile number now as they didn't seem to have it before, but that's easy to deal with if they start using it.

        You know what, my bad - I was in a darn rush. I phoned the number from the papers, which is the Solicitors ....I should of phoned M&S with my offer.

          haha - yea, ring M&S - although they may also refuse to deal in which case yea, use the admissions form that was sent with the N1 claim pack. ;P-;

            A little SLUG based update here....

            Regards M&S and court papers, I have had to use the court form to make an offer of monthly payment on this as everyone was a bit arsey on the telephone, waiting for their relpy.

            ...now on to EGG....

            As detailed in opening post, this has now been passed onto CDUK and I have been getting regular automated phonecalls from them, which is no great shakes - easy enough to ignore.
            Now today they have sent me one of their red: URGENT NOTICE letters - the usual guff I guess, "a course of action open to our clients would be to issue court proceedings" and "failure to make a payment by return could result in..." and could result in "an attachment/assestment of earnings" etc etc.

            Is this an "ignore" situation for time being, or can I bamboozle them in return? I am now fully aware how quickly M&S turned into a court action so Im probably thinking about this one more than I should.....

            ...if only these two could be more like Cahoot?!?

                However you can, if you want, send the account sold letter but i'd miss it and opt for the one above, if I was you.

                  With regards the EGG account..... new letter recieved.....

                  This is fromHL legal & collections solicitors, and quite cheekily they have found out who I work for and googled their address - so I recieved this letter via our main office (not where I work, and not info I have ever given out.)

                  In a nutshell: "we are working on behalf of CDUK, agents for the above creditor. Unless recieve payment within 7 days we will have no alternative but to recommend to our client we proceed with legal action. All communications to our clients only. etc etc"

                  Now this letter is dated over 7 days ago (would of taken a while to get to me at correct location), so my last reply to CDUK will of also crossed this. I guess they can take that as a reply to this letter instead.

                  Should I send anything to these solicitors as well though??? Sounds like Im not far off another court thing. Again. :what

                  Interesting note (although prob not important in the slightest): I got a text and email saying my home address had been changed on my account - I didn't think anything of it as thought it was just a con to get me to phone them up, but checked the last letter I recieved from CDUK and not sure how it even got to my house - it is a mash up of 2 addresses with a postcode for another town altogether. I didn't put my address on my return letter because of this. :quiet

                    ....Just thinking out loud - but a quick search shows that HL legal sort of "rent out" their letterhead to other collection agencies as well. Which kind of tallies with the "IMPORTANT: all payments and communications must be directed to our client" .....they dont sound very involved. Yet.

                      ANOTHER egg update....

                      I've just checked my phone and I have a message from "the legal department at CDUK" that I didn't realize I had. Usually they just say "call us NOW" - but he's left a detailed message.
                      ----Call in regards to the legal letter you have sent us (as advised by Niddy), and clearly from your letter you dont understand the situation on a number of points. There are a few points that you have made that are wrong, I want to talk to you about these, and also find out when you made the request for that information with our clients"

                      Yeah right, any questions or points, put it in writing Bozo! :bad ..... that is, if you can work out my address. hh

                          eh? Is the guy for real? You ought to let me ring him for you and challenge his claim that I am wrong!!

                          However on another more positive note, regards to those that wrote at your work you MUST complain to the ICO & OFT about this as it is highly frowned upon, they cannot this. You simply cannot hassle someone at work, sorry that is harassment and illegal (note, not unlawful)!

                            ***M&S court UPDATE***

                            Happy Christmas Eve to me! two letters in the post this morning, the first from Northampton court saying the judgement has been made against me and that I have to pay. The second that it is being transfered to Norwich court for enforcement.

                            I'm trying not to panic or get down about this right now with the family about to arrive in 30mins...... BUT: I made an offer of payement via the official form to the solicitors like it said on the court forms (via recorded delivery). I didn't here any reply to this. I also called them before this and they said they said I had to put the offer in writing. THE HAVE NEVER REPLIED TO MY OFFER of a monthly payment plan.

                            What is my next step? Do I have a case for desputing this and asking for it to be set aside??? I DID reply to the court forms as instructed but the next info I have is that the hearing took place in my absence.....

                              I have just found proof of delivery and signature for my court form to the address that I was told to reply to with acceptance and an offer on royalmail website for 13/12. The court judgement was made on the 19th in my absence.
                              I've calmed down slightly as I realise I have a month to sort this out probably. I have found a bit that says "if you did reply to the cliam form and believe judgement has been made incorrectly....etc..." .....75 quid though for me to file a form saying this though! great! :grumble

                              Is this what I do next? Do I have a case? What will happen now?
