    I wouldn't think there would be any reason to keep the PO. You have proof, in the form of GnatPest's letter, that they waived the fee of their own volition and that the SAR is therefore a valid one.

    If you wanted to be really safe, you could take a scan of it before handing it over. I don't see any reason to waste £10.

    26/11/12 - Rec'd from Natwest - letter full of apologies for not yet responding to SAR, they are still in the process of compiling and once exhausted will send it all through. They've also returned the (now out of date) postal order and are waiving the fee


    Question is, should I keep and file this PO for any reason or should I get it refunded via the Post Office? Will it be of any relevance at any future point if Natwest take any action?

They believe my credit agreement to be fully compliant and will oppose allegations that it isn't..... With regards to the OFT, they do not hold my account to be in dispute.....     All the searches I've done show Stephen Hester as CEO, not Les Matheson, so I'll send it to him unless I've missed some vital info?

    Dear Mr Hester

    Re Account No: xxxx

    I am very disappointed that I am writing to you but I do believe you may be unaware that staff in your company are not complying with a legal request for data that your company holds on me.

    This is turn is leaving your company open to sanctions from the regulators if I now choose to follow this path. If this letter does not result in my legal request being fulfilled I have no other option but to report the matter.

    Several months ago I sent two subject access request’s (SAR) to your bank (see letter’s attached) requesting all the documentation that your bank holds on me. Both these letters were signed for upon receipt by your bank.

    It is a legal requirement that within 40 days this request is complied with. To date I have received nothing from your company in relation to either request.

    The staff in either location should have taken ownership of the request ensuring if they were not in a position to comply, then the letter was forwarded to the right section. Following my request to collect these documents from a branch, a letter to me showing the request was being processed would also have been polite but to date I have received no reply or notification.

    This is not just a request for some off the cuff information but this is a lawful request for information and your bank is therefore not only giving poor service but also breaking its statutory duty under the DPA.

    I would be interested in your response to this complaint and if you feel I should be reporting this matter to the ICO for them to deal with.

    As you already hold my postal order to the value of £10 (copy receipt enclosed), I will not be enclosing a further fee.

    I look forward to your response within the next 14 days with the requested information.
