            All we have is the application form and Personal Loan - additional conditions which is the first time we have seen the additional conditions we have sent to Niddy

              This is obviously enforceable, due to the start date however it does contain errors - which does affect the validity of the overall agreement however you have no s.127 protection.

              Add up the amounts supplied and compare it with the loan....

              loan to repay) £18,800.92
              loan to yourself) £5,199
              interest) £6,467.64

              TOTAL LOAN = £30,467.64

              However RBS have added 8p to the total which does not belong there as the ACTUAL total is really £30,467.56

              * They forgot to add the missing 8p from the £18,800.92 to the amount that you'd have got.

              The old loan that you paid off with the new £18k one, did that have PPi etc or were you hassled into taking this new loan as a result of the old loan in any way?

              Regards the terms, similarly, you should have been sent a copy but unless you fancy an expensive court battle over the rights and wrongs of 8p i'd suggest blagging this and see where it goes but as with all post 04/07 stuff, you're kinda restricted.....

                The terms you quote as being on the back of the CCA, weren't. These were supplied at a different date - however it's still unenforceable, and you ought to also pay attention to this judgment: CABOT UK LTD v BACHELLIER [2010]

                So respond as follows: CCA Query - Missing Prescribed Terms

                    Niddy once again many thanks
                    Regarding RBS loan we were telephoned on a couple of occassions from what we can remember to refinance, there was no PPI, should we send any reply or just leave it and see what they do

                      I would leave it personally, see what they want to do next - if they get heavy then look to make a token payment.

                      Obv this will also be added to any dmp at the end of your ue trail....

                              14/07/11 Received letter stating "I have received a letter regarding your account. The letter was not signed and as a result I am unable to undertake the action requested. Please sign the letter in space or call us etc." Ignoring for now until further advice is given

                                Niddy, a quick question. If a creditor puts pressure on you to take out a new loan to repay exisiting loan, is there anything 'unfair' going on which could work to a debtor's advantage? I had car finance which expired after 4 years leaving a 4k balance to pay, then the creditor 'offered' me a new loan (much higher APR then old loan) on the day it expired. I stupidly didn't realize I could have shopped around for a better deal.

                                (Sorry to but in on this thread but the post flagged up a point I've not seen anywhere else). Plan B
