    Did I say to send the SAR to Lowell?

    What do I fo now in relation to this? Do I now have to send O2 an SAR request also?

      Utter bollocks!!

      Write back and tell them you do not have to send proof of address and if they correspond with the old one then they're wasting their time and if they try and utilise the courts you'll apply for strike out based on their totally unreasonable behaviour. Then ask "why would I volunteer my address towards a debt; what is the financial gain in that?"

      Then I receive a letter from Arrow Global (who are BC's client) dated 11 August.

      "We thank you for your recent contact in which you informed us of a different address. Under the DPA 1998 we are required to verify this address, therefore we would appreciate if you could provide us with two of the following:-

      ... utility bills etc

      Alternatively, you can verify your address by contacting us on the telephone number below."

      I had not contacted them, I have only just received this letter but on 5 September they sent a further letter.

      "We write further to your letter dated 14/07/11, of which the content has been noted.

      Until such time as we receive verification of the above address we are unable to comply with your request for copy documents under the Comsumer Credit Act 1974. We therefore return your postal order for £1.00.

      If you wish to discuss this matter further please contact us on 0800 1300 165"

      Please advise.

        There is a template for refusal of cca but they can have that next time.

        Just do the above; you'll be fine.

            Niddy re the SAR you initially said to me

            "This is wrong. Stop paying this immediately and send this to Lowells (with a £10 cheque): Subject Access (SAR) - Advanced Request

            They'll probably come back and say you need to send it to O2 but after this length of time, really it is Lowells you need to provide you the info - this is wrong and we will be looking to drop this right back down to the level it was at prior to your leaving the UK.... "


            But you did say to me after that it should have been sent to O2 so they may send the cheque back and we will just re-issue to O2.

                  I have today received a letter from McKenzie Hall:

                  "We are attempting to contact the above named person regarding a personal matter we have been provided your address as being the possible residential address for our subject.

                  Therefore, if you are the person stated above then please contact our office immediately on 0844 etc quoting ref blah blah whereupon further detailed information can be provided.

                  If however you are not the person named above and have any info please contact us on blah blah".

                  I think this may be to do with the Skycard debt even though it is on my credit record as "Capquest" from what I have read, the two are connect. It has been five years since anything has been paid on this debt so a year away from being SB but I am very worried that they lot are involved. I dealt with them once before and they are awful! Really do not want them at my door!

                  What do I do now?

                    If you're female get a male to ring and say stop writing here, I don't know that person. If you're a bloke; ask a woman to do it.

                    Be firm and precise "stop writing to my address. I do not know this person and if you continue sending letters I'll report you to the oft as a breach of your consumer credit licence. Do I make myself clear; I'm sick of it now"....

                          Numerous correspondence since my last post but have been away again so a delay in me receiving them.

                          Lowell - Capital One

                          Lowell sent me a letter on 16 September saying "After liaising with Capital One in an effort to obtain this document we have been advised that it is no longer available due to length of time since the account was opened by you.
                          We are closing your account
                          At this time we have closed our file and will not make any further contact with you concerning payment against this account unless the copy of the agreement is received at some point in the future from Capital One."

                          Then on 21 September I receive a letter from Lowell "We enclose a copy of your original credit agreement with Capital One blah blah we look forward to your proposals for repayment within the next ten days.
                          They have enclosed the first page of a "credit agreement" with my signature looks "please issue to me a capital One card and PIN" etc then about 8 pages of terms and conditions on A4.

                          3 October a letter saying despite previous correspondence we have received no payment and no valid reason for non-payment. Failure to response may result in further action.

                          10 October -Letter from Lowell - Unless we receive payment in 5 days we will instruct solicitors or arrange for a visit to your address to negotiate settlement.

                          17 October - letter from Red - If you do not pay legal action may be taken blah blah.

                          25 October - Letter from Lowell - We have been unable to contact you via phone please telephone our office.

                          26 October - Make us an offer
                          Trying to keep it as to the point as possible (sorry I am not near a scanner right now to scan the docs)

                            Lowell - O2

                            Letter from Red 5 September account passed t us.

                            Letter from Lowell 9 September putting account on hold for 30 days.

                            Sent SAR to O2 on 4 October no response to date.

                            10 October letter from Red account has been passed to us arrange payment.

                            They e-mailed me a couple of times and I stated I have sent an SAR to O2 and am awaiting a response.

                            24 October letter from Lowell - We note your comments and have placed your account on hold for 30 days so that you can contact us with payment proposals.

                            No SAR yet and I want to get Lowell off my back!

                              Arrow - Natwest Credit Card

                              I wrote back to them requesting a CCA as they sent me back the cheque last time and wanted me to verify my address.

                              Letter back from them on 11 October sending the cheque back again "We note the content of your letter as previously stated in our letters we will not comply with your address unless you verify your address. We therefore return your postal order for £1.00"

                                Mackenzie Hall - second letter dated 21 October

                                They have details of the debt

                                Pursuers: Capquest
                                Sky Card
                                Sum £4,670 (interest still being applied it seems)

                                "Despite previous correspondence you have failed to respond. We have obtained this alternative address as a financial link, linking this address to the previous abode. The financial link information was supplied by a credit reference agency.

                                We have been instructed by our client to recover this overdue account on their behalf.

                                Our clients have informed us that they are unaware of any legitimate reason for non-payment of their account and although they would prefer an amicable settlement they will not hesitate to take further action as may be appropriate.

                                Payment deadline: 28 October 2011."

                                This came just after I had phoned and stated no longer at that address. I am worried about this lot though. Dont want this lot at my parents' door. They are real bullies! I dealt with them before.

                                That is everything.
