    Thanks Niddy and In2Deep, I've had a look at that letter I'm worried that it is a bit confrontational as I think this account (loan) is enforceable - I have found what they sent me as the CCA, is it enforceable?

        Ok, letter sent.

        How will I know when the OC has actually sold the debt on to a DCA - I have got my share options now and am able to offer £6K for my debts which total around £40K so about 15%

          if they sell on to a DCA they have to send you a notice of assignment telling you this. I would hold on to your cash for the moment, Niddy is safe hands

            Dont worry - believe.

            I have had the self and same letters from Moorcroft re the self and same lender (also enforceable )- but have not paid a penny for over a year.
            Moorcroft went away eventually - but enevitabley someone else picked up the batton in the name of Gothia....and no doubt someone will follow them.

            Its a proccess and some are more dogged than others.

            Simply folllow the advice and you will be fine.

              Hi All,

              I've had repiles back from both Moorcroft and Rockwell saying the accounts are on hold while they get more information from the OC's

              Also had a couple of letters from CDCS on behalf of Barclays who I have a £12K loan with (from the stuff at the bottom of the letter it seems they ARE actually Barclays!), ignored the first one but the second one is alot more threatening;

              "24 HOUR NOTICE

              We wrote to you recently regarding your account and have not yet received a reply or payment of the outstanding balance.

              If you do not contact us to discuss this we will take one or more of the following actions to recover the debt:-
              • VISIT YOUR HOME ADDRESS
              • OBTAIN A COUNTY COURT JUDGEMENT - your debt to our client will be recognised legally and a record made public of your failure to pay. Such a court order may cause you difficulties in obtaining further credit.... Our clients would then be entitled to seek recovery of the judgement and this may include one of the following:- Attatchment of Earnings, Warrant of Execution, Charging Order
              • ENGAGE A FURTHER DEBT COLLECTION AGENCY ON BEHALF OF OUR CLIENT
              etc...."

              Lots of "ifs" and "mays" - is this the normal sabre rattling or anything to be worried about?

              Also this loan was applied for on the internet so there is no CCA which I have signed - it is marked "signed digitally" or something like that.

                  I'm pretty sure I did before starting my DMP in 2010, I will see if I can find what they sent but I'm pretty sure the CCA they sent was a computer print out with no signatures. Would this make it unenforceable even though it was applied for online?

                      I would send off and get another CCA - see what they really have, and see if it differs from last year!

                          CDCS - it's a time buying exercise and to see what they "really" have....

                              Hi had a letter back from CDCS concerning my Barclays Loan, more of the same from them;

                              "DO NOT IGNORE THIS LETTER

                              In our previous letters we have told you what will happen if your account remains unpaid.

                              As we have still not received payment of the outstanding balance of your account, our client's will place your debt in the hands of a further DCA.

                              etc.."

                              I have received a CCA from them which I have emailed to Niddy for checking, I am willing to settle at some point but for as little as possible. The balance is around £12K but about £5.5K of that is the interest having already paid back £7.5K of the £14.5K borrowed.

                              What to do now? Is the CCA enforceable?

                                The agreement is enforceable.... plus was from March 2007 so very close, but all the PT's are there and look good to me mate.

                                Sorry, but as things stand and the fact they have said they'll sell to a new dca (they're hard aren't they) - I'd probably blag it a wee bit yet.....
