    Sigh. Another letter from Wescot DCA re Halifax, stating "final notice" and the nonsense about "our latest enquiries have now confirmed that you are still resident at this address but we have not received a reply to our previous correspondence." Basically stating pay in full within the next 10 days or further collection activity will be taken, including legal action and a door step collection agency. Still ignore? Or remind that this is UE and insist they return this to Halifax as we did with the last DCA?

    Also... finally received the CCA response from Tesco (after them demanding signature since July 2010), and I have sent it to your email. A bit puzzling in part (noted on email to you) but there it is. Fingers crossed on it. DCA says they've got it on hold at present until they get the statement from Tesco.

      Niddy is still on holiday. I would send the doorstep letter and wait and see what happens.

          I guess this is in relation to your email earlier?

          Well it's unenforceable as it does not comply with s.18 CCA1974 - see here for details: --->
          Multiple Agreements Also, see these examples and you'll see why the agreement they sent you is not enforceable (ie by the other examples) ---> Example Agreements

          Another point to query, the date stamp as you mention is before the actual agreement, plus the PPI is quite old and may not even be relevant, however as a last resort you could reclaim PPi if all else fails...

          So, you respond to Tesco/DCA with the following: ---> CCA Query - Missing Prescribed Terms

                  Received letter from a solicitor today regarding the Halifax account. sigh. Will send them a brief letter stating that this account is in dispute (basically the same letter I sent to the LAST solicitor from the LAST DCA). This is getting ridiculous. Sooner or later, Halifax is going to run out of DCAs to use. They just keep flipping from DCA to DCA. Ah well....

                    Send this, it'll buy you time and shut them up a wee bit: ---> Threat of Legal Action - CCA Request in Default

                          General update: ****updated to add another post below - wretched tesco account - grrrrrr***

                          - Tesco - received letter from Robinson Way Ltd saying "you have not paid..." and indicating "immediate action required", however, there is a possibility that this letter crossed in the mail with my response from their previous letter. As the last letter I sent them pointed out that the CCA they provided was UE, I am going to ignore this letter and wait to see where it goes from here. I see no need to pay postage to reiterate something I just told them. I will let them digest the information a bit and see what their response is at that point.

                          - Halifax - sent the above recommended letter to the solicitors. Interesting to note that while the letterhead for the solicitors letter shows a completely different address (and county!), the envelope that it came in was the same one used by the DCA, with the DCAs address on it. If they're trying to make that effort to make it seem like they are a completely different entity, they really should check their envelopes. Funny the things that make us chuckle at this point. A year ago, a letter from a solicitor would have completely panicked me. Now I'm laughing over the envelope address. What a difference a year makes!

                          - Virgin - they have sent a third letter now saying they are still working on the PPI reimbursement request. Nothing new from the DCA yet since their last letter saying it was separate from their debt and that it has nothing to do with them, so pay up please. LOL

                          - Additions - still receiving regular statements, even though they've admitted in writing that they don't even have a CCA, therefore UE. I'm dutifully filing them away, although I see that the original debt has literally doubled due to all the charges they are piling on each month. Odd, that.

                          - OD - happily paying a reduced sum each month towards paying it off -no late fees, no interest. DCA is being cooperative and agreed on our offer of payment plan immediately with no quibbling at all. The silly thing is that this is what we tried to continue doing with the bank and they weren't willing to cooperate. But then Santander is not known for their humanitarian viewpoint, eh? LOL

                          Anyway, that's it for now in a nutshell. This update is more for me to keep track of where I am, really. It can get confusing sometimes - although much less so now that we have a few accounts down and a bit less to keep organised. LOL

                            we refer to your recent correspondence in which you claim this account is not enforceable. We are satisfied that the documentation provided is sufficient to demonstrate liability and we will not enter into repetitive correspondence regarding this. You data will continue to be processed ... blah blah blah... ending with "we require your payment proposals within 14 days."

                            sigh... but it's not enforceable. Even I can see it from the examples linked above. So now what... final response? demand for them to return it to the original creditor? too lazy to look up the "pulling out hair in frustration" smiley.. but that's what I'm doing... grrrrrr
