If a default has been recorded with the CRAs for this debt then they cannot record another one, if one is still on file they may change it to show they now own it, but it must have the date that the original default was recorded
they can send you as many default notices as they like but not record them on your credit file.
Thanks for the reply, as far as my CRA file all my debts bar 2 have come off.

26/02/16 – full and final settlementsent
07/03/16 – offer rejected wanting meto fill out a financial statement
    11/03/16 – CCA Request sent
    14/03/16 – CCA request received
17/03/16 – letter received sayingthey will provide info in 12 working days.
21/03/16- Letter received acknowledging request for documents they have forwarded it to HFC Bank PLC(letter dated 17/03/16)
01/04/16 - Letter received stating that they are unable to supply a copy of the agreement or statements and acknowledge that it cant be enforced.
28/04/16 - letter received stating documents issued under section 87(1) of the consumer credit act 1974 in relation to my account. And a default notice on the other side of the letter.
So first contact from them since they admitted that at this time they can't comply with my cca request so they have sent a letter chasing payment and put a default notice threat on the back of this letter( I'm under the impression they can't default a debt twice so good luck with that)
they have given me until 12 May to pay up so will sit tight for now.

I would just sit tight for now and see what comes next, Littlewoods are very rarely going to have a CCA as they always sent goods on approval, then sent an agreement for you to sign and keep hold of, I know I never sent a copy of any of mine back to them.

I know this account is riddled withcharges as I have found a statement from 2008 and there was 2 admin charges- 13 march 2008 £5 and 26 march 2008 £5
    11/03/16 – SAR request sent
14/03/16 – SAR request signed for
16/04/16 - littlewoods have sent me over 50 pages of statements but no copy of an agreement.
so received all statements they have on record but no copy of a signed agreement, as littlewoods have been marking my credit file with AP markers for the last 6 years and a 6 for the last 3 months I thought I would check how many missed payments I had. I found that I had 7 consecutive missed payments in 2007, so I'm under the impression this should have been defaulted back then and would be off my record.
so has anyone got any advice on what to do next?
