      I'd copy the letter text and paste to word and add anti tamper then just semi sign in his name.

      Simples.
      I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

          It's worth getting this letter absolutely right in case the s.78 request document should ever end up in front of a judge in court - which I very much doubt

                if they can recon an agreement we can recon a s.78

                  It's not so much an issue, in court or anywhere else, who sent the request. If that ever came into the argument Mr would simply say he asked Mrs to sign it to avoid any possible foul play and he fully authorised her to do it - thus meaning it's legit. There's no intentional deceit / fraud as Mr will confirm he authorised the request.

                  End of argument. It's a valid request. Remember it's always valid if the bank treat it as a s.78 and respond. If they refuse and demand a signature then it's not a valid request as such (arguable).....

                    Thanks for the replies. Early start plus difficult bedtime mean i haven't really processed the info, but i do appreciate the time you're taking to help me.

                    We've had 2 letters today from Buchanan Clark and Wells. One on their letter head saying Barclays want £300, the other purportedly from Barclays (but in the same envelope and with exactly the same font and contact details) saying they've transferred the debt to BCW. What do i do about these please? Last contact i know about with Barclays was about 18 months ago when we went to joint finances.

                    Am i allowed to swear on here? Because i really really want to

                      Could you if possible list all debts like below .........? And have a read here ---> Unenforceability Diaries - Read me First!


                      • Type of account (credit card/loan)

                      • Date commenced (ideally before Apr 2007)

                      • Approx balance

                      • Date last paid (approximate date you last made a FULL payment)

                      • Are you on arrangement or not paying

                      • Status (default/in arrears/up-to-date)

                      • Account owner (who is writing to you, a DCA or the lender)

                                I'm going to try to send to both. But that means i either do it at my parents' who i don't want to tell or have to keep a 1yo amused while i do it at the library.
