I know the others have said not to respond to Capquest but I think you should send the Telephone Harrassment letter which you will find in the templates section of AAD+. You could add an extra line saying that you have a long term illness and the calls are making you worse. Hopefully then the calls and texts should stop.

          Hi everyone,

          I have a situation that is complicated and I can't work out whether there is likely to be a solution. In short, I thought I'd never use or need credit again, but I now need to raise quite a chunk of money to pay for medical treatment. If anyone can suggest a way forward I'd be very grateful. I'll try to be as brief as possible. The question itself is not directly related to UE, but I'm worried about somehow activating the creditors if I apply for more credit. Here's the background:

          i started off off on the UE route around 4 years ago. Thanks to Niddy and this amazing forum, all is going well on that front. I started off with £65k of unsecured debt, and that's now come down to around £45k insofar as creditors to the tune of £20k have given up and no longer appear on my credit file. The £45k remaining were all with MBNA, now with DCAs. As I recall, all three credit card debts making up the £45k are UE, and will become SB next year. Defaults were all in 2012, and no payments since. So, on that front, so far so very good

          Not relevant to UE, but relevant to my question is a problem with a High st mortgage. The story here is long but the key facts are as follows. Had the mortgage some years. Mortgage is around a third of property value so plenty of equity. When I fell ill some years back went into meltdown and had possession proceedings. I paid arrears and costs in full, and haven't missed a payment since (since 2014). History after that is very complicated but essentially Mortgage co wrongly added thousands of pounds to my account, charged me solicitors fees for investigating their own error and large amount of charges and arrears fees. At its simplest, I haven't missed a payment since all arrears and costs were paid so cannot be in arrears. This has been the subject of ongoing investigation by ombudsman for near.y three years now, and no end in site.

          Although i I am optimistic that the Mortgage saga will eventually be resolved, my problem is that my credit file shows 2 months of arrears ever since The mortgage co wrongly inflated my outstanding balance (it is obvious from the credit file that this is a nonsense as it is clear from the balances on the file that I have made all relevant payments.

          Although stressed by the ongoing saga with the mortgage co, I hadn't been worried about my credit file because I had t anticipated wanting credit. However, I now need a loan urgently if at all possible and I'm wondering whether the wrongly stated mortgage arrears will prevent me getting one.

          i need the loan to pay for what for me is necessary surgery but which the NHS won't do before a separate major operation which the NHS will do. My consultant tells me it is essential to have the 'elective' surgery before the NHS operation. My difficulty is that the NHS operation can only be done in a limited time window because it will become ineffective/inappropriate when my chronic illness deteriorates beyond a certain point.

          so, to pay for the elective surgery which I need just as soon as possible, I need £20k to £25k. I would be confident of being able to repay such a loan within a couple of years. My questions are:

          1. Given the above facts, is there any likelihood of being able to get a bad credit loan (whether secured or unsecured)
          2. If yes, would applying for this somehow cause my existing creditors to pursue me aggressively?

            Demand they fix the mortgage error reporting as that WILL affect you. If there are other (MBNA) defaults it's unlikely you'll get offered loans I'm afraid. A specialist mortgage firm may help...?

              Thanks Niddy. You're a star. Yes, I've asked the mortgage co to correct my credit file. It's so obviously wrong that I am hopeful they will sort that. Assuming they do, and I can get help from a specialist mortgage firm, would new lending somehow be likely to stir MBNA/the DCAs? ( I appreciate there are no certainties)

                It's not so much that it'll stir them - but if you have defaults you'd struggle for mainstream loans mate. Raise a dispute with the CRA against the entry as well if you want mortgage entries sorted.

                There are specialised firms out there but with live defaults it'd be slim pickings and high Apr if anything at all.

                  Thanks again Niddy. Yes, I've now raised a dispute with CRA. And, without any expectation, I'll check out a specialised firm. You've reduced my stress levels, as it's good to understand the position even if it's a difficult one. )

                              I think you need to take into account the default date.

                                As still waving has said there is some debate over when the 6 years starts and so try to keep going until at least a month after the default was registered.
