    Evening all,

    Still a bit quiet, which is nice while it lasts

    On another UE point.

    I will be moving house next year and need to know what's the best way to deal with it from not admitting the debt in writing.

    Obviously, I would prefer not to give these muppets my new address, and can get away with mail redirection for up to 2 years.

    Thing is, if I change my address with them in writing, does that acknowledge the debt and reset the SB clock?

    If I do it by phone, I have no evidence should they ignore and seek to get an undefended CCJ at my old address as they know I might not get the paperwork.

    Ideas?

    Afternoon folks,

    Quick update:
    Updated my Marbles card post. They have agreed to default the account as per the date specified in the default notice after I threatened them with the FOS if they didn't. Best get it over with as its not the only one...

    Not much on anything else.

    Have noted that my Cahoot card is being reported to noddle as ?, so maybe they are planning to sell it.

    Also noted that the cahoot/santander flexi loan is being reported a month late when actually its about 5. Will keep an eye on this as I would rather get defaulted on this and the cahoot card soon as they are the last ones.

    Oh and final thing I hadnt really factored in.

    If going UE we tend to forget PPI until the day we reach SB.

    Why try and claim something when actually your trying to feck em over on everything. But up to you what you wish to do. No down nose looking here.

    Sure Niddy or the Mods can give you the technical reasons why just the above reason fits what I need to know.

    MBNA said they wrote when they took over the account and said I could cancel it free of charge, TBH, I didn't know it was on the account and when I did I cancelled it.

    They said I fitted the criteria, 18-70, working (and alive I bet )

    I have complained, filling out the standard PPI form. I sent to MBNA and they said its really up to Satander.

    I'll send it to the FOS and let them figure it out.

    I guess I should also send an identical complaint to Satander with a copy of the A&L letter?

    I have a lot of good reasons why it was missold, I included them all on the PPI form the FOS use when I complained to MBNA.

    Agree with Ken.

    HSBC used the same excuses, "I had every opportunity to cancel the PPI at the time the loan was active, and it would have been explained at the time"

    This is of course bollox, the point is, it was missold for those very reasons, it was not explained correctly, the fact you could cancel anytime is also irrelevant.

    Their answer is just a fob off, because when or if you take it to the FOS it will take 12-14 months before they get round to agreeing with your case. MBNA know this, so do HSBC, which is why they say what they do.

    Dont matter what happened after the event.

    The clue is in the word miss selling. If it were miss keeping it on years after the event because it was bad value and wouldnt pay out cause it was a pile of poo then I would agree with MBNA.

    But its called miss selling for a reason so MBNA talk crap.

    Did MBNA when they took over the card from A&L write to you and explicitly say this product is rubbish and you can cancel if you want to but you wrote back and said something along the lines of no actually I like being ripped off and I think you should take lots more.

    Of course they and you didnt. They kept it on because it was good money for them. You kept it on because you actually trusted the banks back then like we all did.

    The only bit of truth is that Santander should be firmly in your sights on this as they own what was A&L now.

    What reasons are you hoping to give for the reason you were miss sold the PPI.
    Have you started a complaint yet? The reason I am asking is MBNA are trying to timebar some of these difficult complaints by referring all the way back to first contact.

    They are doing something very very strange with PPI refunds.
    PPI was cancelled when i realised I had it, many years ago.

    I claimed PPI mis-selling and MBNA rejected it as they bought it from A&L in 2003 I think and say i could have cancelled it then. So as they didn't sell it, not their fault and they have forwarded it to Santander as they would have owned A&L a the time of sale...

    I do intend on sending to FOS, just waiting til they sell the account so they can't nick anything if I do get a result with FOS. I think theres at least a grand to get back from MBNA from when they took it over.

    Will also be chasing up with Santander, but not heard a bean seince MBNA say they forwarded my complaint early May.

    All odd really, as I thought when they took over a business they inherited the job lot including being responsible for this kind of claim.
