    So, based on the above can you please clarify - you say there were three loans - are all three paid off in full? If not, can you please explain what is the situation..?

    You say you have a card, is that paid off or does it have a balance and which bank issued it, ie BOS/HFX/LLoyds....?

        Defaulted 25/08/2009
        Debt is still with Lloyds TSB

        01/02/2013 - CCA sent today (although loan taken out after 2007 so no doubt will be enforceable)

          Ok, so there were two older loans both paid off in full and then a new one taken in 2007 along with a card, both holding a balance...?

          If so forget any reclaim, that won't benefit you sadly. Not yet anyway.

          As such, basically you want the two CCA's for the loan & card and when you get them, let me see and we'll know more. However, based on their letter not enclosing such a CCA you'd be best sending this --> Our Templates | Unenforceability Templates | CCA Request - Final Demand

          As stated, don't worry about the reclaim yet - you can look at this later if/when they get heavy....

            Only the 2 loans that I have been sent agreements for are actually paid off. The loan that I actually requested the agreement for still has a balance of £19000 and my credit card has £9000. Both are Lloyds TSB and both are in repayment plans. I'm still waiting on both of these agreements.

            So should I just start a PPI claim for the 2 preference accounts without mentioning any other accounts? And should I do this by completing the FOS questionnaire and if so who should I send it to??

              Nope, sit tight for now - you need the other two CCA's before doing anything. Now I am clear as to your circs, it's easier to answer more definitively.

              Just sit tight and give them another week to send the CCA's for the other two accounts (the live ones) then send a reminder.....

              Is there any chance they've replied directly to your DMP provider...? Have you checked with them? UE is not an option on a managed DMP via a company so you'd need to drop out of that as well and do it yourself if you consider UE...

                Will wait until next week and if nothing is received I'll send the reminder.

                Yes, I have considered that I will probably need to come out of my DMP and do it myself if it comes to that. Will see how it all pans out.

                  Hi,

                  No, hold off for now on the PPI claims. It may cause further problems with the bigger accounts.

                  Niddy has linked the next letter above to send, CCA request Final Demand.

                  When you get the CCA's returned for the 2 accounts, email them to Niddy, Unaltered. They are perfectly safe.

                          Right ok, I can see Niddy said to sit back for now on the PPI reclaiming.

                          I shall come back to this again to check, otherwise if it's decided to make a reclaiming complaint, feel free to start a link on the PPI reclaiming part of the forums. I will keep my eyes open.

                              Hi all!!

                              Just updated my diary, have had a reply from LTSB re the credit card, it says they are 'enclosing a copy of the reconstituted version of your executed agreement and a signed statement of your account'. They say by providing these documents they have satisfied their obligation under section 78 and they are not required to provide a copy of the original signed agreement, but that they are still endeavouring to locate the copy of my signed agreement etc etc. Will try and scan it in the next day or 2 to send to Niddy.
