RBS CCA not furnished - dispute as to opening date of card and need for submission of CCA

    Dear all,

    [Type of account - RBS credit card
    Date commenced Commenced around 1985/6
    Approx balance around £8749
    Date last paid last full payment in February 2022
    on self managed payment plan
    Status - in arrears since I have had no proper response to our CCA request
    SAR request sent 17 june 2022

    I have just received a response from RBS asking for proof of identity and address for them to respond to my SAR request, and a list of what specific elements I am requesting information for. I asked for all information - as you advised - having been told that I agreed to my credit card whilst still a full-time student in 1984 though my recollection is that this account was agreed in 1986 or 1987.

    Should I ask for only the credit card in question or still demand all information they hold? They also asked me to reply by email. I trust that a hard copy would be better as a legally traceable record. I would value hearing your advice before responding to them.

      Hi

      You are entitled to have everything they hold about any account deemed to be yours (you didn't specify a particular account in your request, did you?). Ask for everything, and in hard copy (easier to read through, IMO).

        they are writing to at this address., they know from records it is you> they are the pits. anyway the request they have had and 30 days was running from the date of request, they have written to you at thgis addres before etc etc,

        CCA Request get free proof of posting if advised to request true copy.

        Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, I hereby request that you supply me with any and all historical data in your possession which relates to me and that I am entitled to under section 7(1) of the Act.

        If you store any of the older records on microfiche, please be aware that the Information Commissioner deems this to be a relevant filing system under the Act. As such, any microfiche data must be sent to me in fully legible and comprehensible form.

        Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my business with you.

        If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.

        You have 30 days in which to comply.

            if they have been sending accounts etc to that address no ID needed the letter enough. they are on time limit from 30 days last request this is a chasser

              SAR Signature Request suggest you send this one first give them 7 days before the other one, if they do not respond,

                Dear All - 28/10/2022 I received a polite letter from Zinc offering to help me with my payment plan for this card. Should I ignore this at this point in time?
                I still contend that there is no agreement for this card as they have not furnished me with one.

                  Yes, file and ignore.

                  Did you get the SAR information that you requested? You were going to send ID and request all info they hold.
