Remember there is a lot more to enforceability than just the agreement but it would be a shame to have to test that in court on such a relatively small amount. I imagine that while you keep paying Capital One will hold on to it - not sure how much you are paying per month.

Do you still have the default notice from 2010? I ask because Capital One defaulted me around that time but did not send a proper DN set out in the right way. As a result, when they sold it to Lowell and Lowell did try court, they lost. As it happens I had kept the DN which wasn't a real DN , I think they called it a notice of default.

Oh and in my case, the agreement was good, even included my signature so there was no doubt I had signed it.

Thank you for your response.

I am going to have a look and see if I can find the Default Notice. I have a cupboard of paperwork ha ha, so I cant promise. I agree its a small amount and I was kind of expecting this to be totally honest. I am currently paying a really small amount... so maybe I will just pay this one off at some point. Hopefully it will get sold on and I can negotiate a F&F here once the payments stop!
