  • Gustavo's Diary

    Hi All,

Looking to get my credit file back in order for a better future, thought ill start a diary and update it throughout my journey to become debt free, also receive advice as I work on repairing my credit file. Must point out I’m a home owner with a running mortgage which is currently rented out privately.

I have not sent any other CCA request apart from one to Lantern which was in November 2019, I have not received any other payment request or letters demanding payments so far, and things have gone quiet for a few years now, I haven't got any paperwork for any of the below debts ill start filling them from now.

Thank you for the help and guidance.

July 2019 – Payday company gone into administration, made an unaffordability complaint received email from administrators staying: “We can confirm that your loan was not included in the sales to Shelby or Lantern, and as your loan has been repaid in full, you do not need to make any further repayments to CTL”. Find this strange as I thought I had an outstanding balance.

November 2019 – CCA requested & received from Lantern

June 2020 – Complaint email sent to Lantern to stop with their postal letter harassment for payment, which I also included the email response from the administrators. I didn’t know better until I found this forum should have sat on my hands rather than entertain the DCA.

June 2020 – CCA sent to Never-In-Doubt for review
              June 2020 - Never-In-Doubt advice to file & ignore

Were you aware of this CCJ at the time the claim was issued. If not were they aware you had moved?

Was this an unregulated debt or is a chunk of the money owed doe to forward loaded interest?

Only noticed the CCJ last month, yes the original lender was aware of my new address when I moved out, registered with the elector roll since moving out.

Original lender is Santander so I guess it's regulated?

                          Hello

(I've replied to your earlier email.)

If the claim for this Santander loan was served on an address where you no longer lived at the time then an application to set it aside may be the way forward.

Has this debt, and the associated CCJ, been assigned or is Santander still the owner because I don't recognise DFW Law in the UK? However there is a firm called DWF which has offices in the UK.

DWF is the solicitors that were used by defendants in my road accident case 12yr ago. They worked on behalf of Aviva at the time. Very slick had me followed within weeks of accident.

Thank you for the reply, I have also sent you a email back.

Sorry that was a typo meant DWF, now amended this in my original post. From the info I gathered after speaking to the court, the served address used was a previous address, I'm 100% sure I changed all my address details to the new one prior to moving out.
