21/6 after dodging calls from MBNA for two days running they caught me unawares today. It was a brief call to confirm my identity and to say that as some of my SAR information may be recordings of calls then they will email that to me.
JUL 10/7 I've been dodging MBNA calls the past couple of days and today they caught me again. Another private caller on my mobile this time. It was however a very brief call to ask me if my DSAR (I'm assuming that is the same as a SAR?) was what I actually wanted or was it for PPI? I confirmed yes I wanted SAR and no its not for PPI. He then said he would send me the info I had requested and that there was quite a lot of it ... I wait to see ..
11/7 SAR/GDPR data received from MBNA via email. There are a lot of documents including statements, copies of letters, CCA. No mention tho of any contact from PRA to request CCA.
AUG 11/8 Letter received from PRA in response to my CCA request. Have enclosed a copy statement from 13th May 2015 and that's it! Letter does say they are awaiting further documents in order to complete my request and that the debt is currently UE.
13/8 Letter received from PRA dated 10th Aug 2018 with copy of CCA asking me to 'contact them within 10 days of receipt of the letter to discuss my account with me and come to a mutually acceptable agreement'.

Did this Santander credit card start life as Santander or could it have been an Alliance & Leicester or Abbey account bought by Santander?

Or even a credit card account owned by G E Money who had acquired numerous store cards around that time?

A lot of emphasis is placed on whether a credit agreement is compliant, but there are others reasons to make a debt unenforceable and one of them is problems with the assignment chain.

Hi Di,

Thanks for your comments - that has given me much to consider. Although I cant find any record of it I am pretty sure that my Santander card started out as an Abbey credit card and was later re-branded under the Santander name.

However what I am 100% certain of is that my two MBNA credit cards were both rebranded - one was originally Virgin and the other Play.com. Hopefully this is significant and helps!

I will update the account posts to reflect these 'former lives' along with some additional history on the timelines so you can have a better picture of what's happened.

It is always useful to know exactly who had the debt originally. Sometimes when they recon they get it wrong. Also, it seems maybe Santander do not sell on debts let's hope they do not follow through with action. I have a santander od

Thanks - I had no idea that was the case until Di mentioned it in her post to me.

With regards Santander and selling on. I cant find it ATM but my Santander account was handed to Wescot to manage. I never hear anything from them tho and think they must have now handed it back to Santander because I get statements sent periodically directly from Santander. Also I believe Wescot dont actually buy debts, they only manage on behalf of the lender

Are you certain this Virgin account was opened in 2008 not 2007?

It seems MBNA were happy to accept £1 per month token payments on this £15k debt which would take 1,270 years to clear at that rate. When was it assigned (sold) to PRA and what has been their approach towards you since then?

Thanks for your comments and and queries on the Virgin account. According to my credit report the account was opened on 14th Nov 2008. However I didn't keep the original paperwork (never thought I'd need it

) but I do remember being written to at some point saying MBNA was taking over the account. I dont know how these things get recorded on credit files but might 14th Nov 2008 be the date which MBNA took it over from Virgin or would that be the date I opened the account with Virgin? I have requested the CCA but as yet it's not been sent to me from PRA so maybe this will clarify things further .. or not..

Yes I know I think I might be dead way before the debt ever gets paid

but hey the other MBNA card would take even longer to pay off and they have accepted the payment plan for that one too at £1 per month.

What is interesting though is that for the Virgin card, PRA did write to me out of the blue and offered me a FFS for £9147.45. Which is a big discount. I didnt have the funds to pay it so that has now expired. PRA took over the debt from MBNA in July 2016 and the FFS settlement offer was made by PRA on 10th Nov 2017. I have not had a similar FFS offer from PRA for the other MBNA debt - so maybe they believe the Virgin debt is UE?!? I will update my diary entry now so that all this info is in one place on the Virgin account post,
