    Hi again

    I have been thinking long and hard about your situation

    The UE route is not for the feint hearted, by that I mean you need to keep to it and be ready for lots of letters and lots of phone calls. I sometimes long for the days when I had post everyday, now I go a week without anything.

    I was in the position that nothing they could do to me was worse than i had been through myself, I had no job, no assets, was really quite unwell and had ways of spending money that would make your eyes water- at least spending it on a Gucci handbag gives you something to look back on. I wobbled last year when I received a claim and without the help of Di, Jo and another lady I know, would probably have gone BR but i didn't , I won my claim and now all but a couple of Grand are statute barred (unless they find some of the letters I wrote when I was in my darkest place)

    Anyway I know for you a CCJ or BR is not an option but at the same time if you start the UE journey and get a claim, if it is the best option you can make an arrangement to pay without getting the CCJ (as long as you stick to it)

    Just a bit of info
    Fredricksons are ( or were) part of the Lowell group of companies based in Leeds so you could send the CCA request to the 9 Savanna Way address or to this one Tolworth Tower, Ewell Road, Surbiton, Surrey, KT6 7EL

    Just out of interest, do you still any of the default notices which companies may have sent you?

    Ombudsman - carry on and do not sit back send CCA1974 request with the £1.00 Recorded Delivery, never sit back on Ombudsman issues as they take long time and usually end up negative response. even a CCA request will not necessary put account on hold, as owners can still issue court proceedings at any time, BUT outstanding issues i.e. CCA1974 request kicks in read other threads and get court action methods idea

    Aqua sold my account to Cabot in 2017. They sent me a lot of letters and phone calls. Answered once and told them I am disputing the account with Aqua and no other contact with them. Last letter they sent me an I&E form in order to start a payment plan with them.
    01.02.2018 Letter from Cabot: ,, at the moment we don't have payments being received on your account. As a reasonable next action to recover the outstanding balance your account has been reviewed for legal action. You need to contact us within 28 days so that we can prevent this from happening.''

    Are they really go to court or just want to intimidate me? I've mailed them that I am disputing the account with Aqua but still they send me letters monthly. The adjudicator didn't uphold my complaint and now is at Ombudsman queue. Should I send them CCA request or to put the account on hold until the Ombudsman will review my case?

    With regard to the Credit Card agreement from HSBC.....Keep all that safe.....The missing date could be a good thing for you

    However you still need to make an official CCA request ( With the £1 payment) to them........It is a legal step/process to make the official request and is there to be used for your protection should it need to be - So follow the process you must and still send the CCA

    Answering the phone is no problem.....although its often easier to ignore if you know its a DCA etc - You did exactly as I would suggest.......Hopefully they will write from now on

    If the P.O Box number is the only address on any correspondance you receive from Fredricksons........Then send it to the P.O. box number........Send Recorded.......You will still get an online proof of delivery in most cases. Check the Royal Mail website a few days after posting.

    I send most of my CCA requests to P.O. box numbers all those years ago and they all got there ok

    You are now making progress with this........feels better doesn't it .........Your doing great

    Meantime I've received a letter from Credit Security who is handle my HSBC Credit card. I haven't requested from them anything yet, but 3 month ago I sent an email to prove the existing debit. This is the letter from them:

    ,,we enclose a copy of the Final Demand letter issued on March 2017, together with a copy of the Credit Agreement and confirm the above balance remains outstanding.

    In this circumstances please call us so we can talk through your situation and agree an affordable plan. Alternatively, please complete the i&e form on the back of this letter.

    We trust we have clarified the position and look forward to hearing from you.''


    And they sent a copy of Credit Card Agreement from HSBC, with my signature but the date is missing next to my signature. I remember that in the bank they said I am approved for £500 limit, but when I received the card, the limit was £1.000. I see on application record new card 500, total 500, existing 0, offered limit 1.000. What should I do with them?

    And today Fredrickson called me and answered by mistake but told them I want to communicate with them only in writing and the person said they will delete my phone number from their records and will wait for my letter. I don't know if I should have answered the phone.

    I want to sent CCA request to Fredrickson but I see on their letter the address is PO Box 990A, Surbiton and on their website they have the same address plus a registered address which is in Leeds, a normal address, not PO. Where should I send CCA request with a recorded delivery?

    No worries......Get the HSBC ones done first......But send the CCA request to who ever is handling the account at the minute / DCA etc

    Remember to include your £1 postal order or cheque ( Postal order is best) - Keep the postal order receipt

    Send Recorded delivery - Keep the receipt and print off the signature delivery receipt from the Royal mail,website a few days later

    File it all away safe

    When you get your CCA reply back - We can get that checked and see where you stand

    Thanks a lot for help Spud. It's time to start moving. For the moment HSBC are the one who are chasing me. Them and the DCA's who work in their behalf. Cabot also send letters but not threatening and Asset Collection sent me yesterday one email to remind me that my account is defaulted and I am not on payment plan with them.

    You've come to the right place to ask about managing your debts. If you look at some of the 'Unenforceable Diaries' you'll see how much help and support you and your partner will get from the forum.

    Can you start a new thread for your own diary where you can list the 17 debts (both yours and your partners) and then each time something happens you'll be guided on your next step.

    There is a template in their that tells the creditors you will only communicate in writing- at least I think there is, there always used to be. I have used it with great success on many occasions

    No worries....If you are looking to follow the UE route then the first step if you have not done so already would be to read through some of the UE guides on the forum and possibly other diaries to get a feel of it.

    The next practical step would be to send CCA requests to all of your Creditors/DCA's ( Who ever is chasing you now - not necessarily the owner)

    So say for the Fredrickson one ( HSBC loan ) send the CCA request to Fredricksons

    That is the only way in which you will be able to get a copy of the paperwork and see where you stand. You cannot make any firm decisions until you know where you are

    If you look at the template letters in the AAD+ section and look under Unenforceability templates - Look in section 1 - Starting out.....You need the CCA request letter - Click on the letter you need - Fill in the details such as addresses and account number ( The bits to ammend/update will be in bold print) and print it off - don't alter the wording of the main body of the letter as they are very carefully worded

    Send Recorded delivery to the DCA and keep the receipt

    Any that are for Bank accounts/overdraft use the specialist Bank account 1 - CCA request letter - There are 2 - Make sure you use version 1

    Any problems post up and we will get you sorted

    What I would say - Without reading back through your diary - If there are any accounts where they are not chasing you at the moment despite you not paying - Perhaps leave these for now and concentrate on the ones who are chasing first - I will explain more later on

    Have a look at the other diaries and how they are set out where letters are listed with a date etc. If you are able, just update each of your debts at the start of your diary with a list of all the letters you have received - That way we will be able to see at a glance who is chasing and when

    We will soon have you feeling better about all of this

    Thanks for reply Spud. I think I was misunderstood. As I am already here and started my diary because I want to follow the UE path. Like you said in another reply for me, maybe not all my debts might be unenforceable, but still you can tell me how to deal with their sharks, or how to reply to their tons of calls or threats. So please bear with me and help me with my first steps.
