    hi Twinkie, i am so pleased you have found us, we'll help you, don't you worry about that....

    Sorry to hear you're in pain...there are a few of us on here with health issues so you're not alone

    I went bankrupt back in 2009 which did help to reduce the stress. However, i didn't know much about UE at the time. Looking back i wish i'd tried UE first.

    The main thing is to try not to worry about the debts. You've come to the right place and you'll feel stronger the more you read on here.

      Hello Twinkie and welcome to AAD. You are now definitely in the right place to get the help and support you need to see you through this, and to gradually improve your life from this moment on.

      You are already asking many intelligent and important questions, especially regarding the formal debt solutions such as BR and DRO. My only comment here would be that it would be a desperate shame to opt for one of these solutions without knowing exactly where you stand regarding enforceability of these alleged debts. You may just be throwing away an opportunity to extricate yourself from this situation without needing to go this far.

      If you choose to request the documentation under section 77/78 of the CCA 1974, you are really taking no risk. You can always think about the formal solutions later if this doesn't work out for you.

      Bear in mind also that even if an agreement does turn out to be enforceable there is no guarantee that the alleged creditor will know this. There are several posters on this site who have been blagging enforceable accounts for years, and you may be able to do the same.

      It is also worth bearing in mind that there is not a great deal of point in a creditor taking court action over these alleged debts. This costs them money, and there is no guarantee that they would be successful. Even if they were, the court would only be awarding minimum payments in your situation, and it would take several years for them to recoup their investment. At any time, you could move for DRO and they would get nothing. As a commercial decision, it would be insanity.

      There are some clowns, however, who like to issue court papers on just about any debt, because they are relying on people not knowing their rights, and they hope to get judgment in default. Brian “Brain Farter” Carter is one of those, hence the difficulty you are having with this particular odious individual. If anyone fights the case, he will usually pull out at the Allocation Questionnaire stage and seek an easier target.

      Coward Hohen is another slimeball from the same mould. I've seen a thread on here where he issued papers for a double figure debt, and once again pulled out at the AQ stage.

      Anyway, the best thing to do now is to start your diary and get these alleged debts listed. Here is an example of a diary which Niddy praised that you can model for your own -

        Twinkie. The people on here are good at sorting out other peoples debts because we've all messed up ourselves at some point You're in good company!

        Once you feel you've got the money thing under control it would be good to sort out your living conditions too. If your rented home is in disrepair then the Landlord has a legal duty to fix it up. You've got enough to think about at the moment but one call to the Environmental Health Officer at your local council should start the ball rolling If you're in social housing (Housing Association or council property) there should be a contact officer to deal with all this stuff for you

        Things will get better from now on starting with your approach to us today

            You've been bombarded with loads of info today but the bottom line is we all want you to feel better whatever you decide to do. I'm a big fan of dogs so I'm happy to hear you've got some. My dally saved my sanity more than 101 times !

              Well, I hope you don't read this till the morning. You've had a hell of a lot to take on on here today. Hopefully a good rest and a bit of time to think will help. Remember there's no rush to do anything, and maybe just being in a place where you know we all care will make a difference in itself, it's bound to lift a little of the pressure which, as most of us know, can be horrendous.

                  I got so stressed out by my debts last year that whole chunks of my hair fell out and not just on my head Golly, I hope none of the Boyz are reading this post

                  Anyway a year down the line and I don't give a damn about any of my creditors any more - so it just goes to prove that any thing is possible when you join the AAD Club

                    Hi Twinkie, don't rush responding to me, I'm sure I'm not the only one to have been in touch if I know this site. It is unbelievably caring and has the habit of picking you up when you're feeling really down. It's got something no other site I know on the internet has managed to achieve.

                    Just take your time, try to feel posting on here is a genuine achievement - it is! Respond to me when and if you want. Meanwhile take care of yourself and remember there's a load of people here rooting for you now, so keep us up to date as and when you are well enough and feel up to it.

                              Just a quick welcome and to add to what others have said you will get all the help you need here.
                              We were in a very similar place to you almost a year ago now but AAD has helped us realise that no matter how bad you think things are there is always someone here to offer help and advice so try not to stress about things too much as your health matters more than anything else.

                                Hi Twinkie

                                Just wanted to say that for me this site was literally a life saver. Before I found Niddy :niddy, and his 'gang' I was in a very 'dark' place. Chronic illness, disability, poor housing and debts had really taken their toll on my will to live. I really was ready to 'give up'. Your first post really struck a chord with me, and many others here, I'm sure.

                                I know how difficult writing that first post must have been for you but it shows that you have the strength to get through this, one day at a time......

                                I know I sometimes felt that it was two steps forward then one step back, sometimes I just felt like but with the help and support from this site my debt problem is now, well not really a problem for me. To be honest some days I actually miss not having any post to deal with, nobody seems to want to write to me any more .

                                Best wishes and a big 'woof' from 'T' to you too.
