    Arden have sent me three letters.

    One dated 11th Dec.

    This one basically states the situation of non-payment is unacceptable and that the balance is outstanding and payable. "You are in breach of this requirement."

    They offer me two options, one to pay monthly instalments and the other make a lump sum payment.

    Should you do nothing we may take further action.... please do not ignore this letter.....

    Contact us on 0800....

    I ignored that one, hopefully correct!

    They then wrote again on 18th Dec (to paraphrase):

    "Thank you for your recent letter (this was the one I sent about " Our Templates | Harassment & Intimidation Templates | Harassment & Threat of Doorstep-Visit")

    We have not been able to contact you as we do not hold a telephone number for you.

    There is still an outstanding balance and no long term arrangement to pay.....

    Please complete the enclosed customer financial statement and return this to us......"

    I've ignored that one as well, is that correct?

    Latest letter dated 24th December:

    "FINAL DEMAND

    I am extremely concerned that despite all of our attempts to contact you and discuss the above account you persist in refusing to address the outstanding balance.

    I must advise you that should you continue to ignore our requests for payment proposals we will be left with no alternative but to review your account for further action to be taken. As outlined in our previous correspondence this may mean a visit is made to your home to discuss your reason for non-payment or your account being passed to our solicitors to instigate legal proceedings.

    We will review your account in line with the above 7 calendar days from the date of this letter. Please contact our offices immediately on 0800 to discuss the options available to discharge yourself of this responsibility.

    Well, the 7 calendar days are already up as due to the Christmas post I only got the letter on Friday 4th January.

    Does the "further action" mean even more dull letters from them or are they actually going to take me to court over it?

    I'm not working so I cannot afford to pay them anything even if they went to court and won, looks like it debtors jail for me then!

      I would say that ignoring the first two letters was the right thing to do. Certainly, refusing to send in any “customer financial statement” was the right thing to do.

      This latest letter is so silly and pathetic it scarcely warrants a response either. What a ridiculous stunt to send a letter dated 24th December, and then give 7 calendar days, knowing that the majority of people will have other engagements during those seven days. They also know perfectly well that the letter won't reach you until the 7 days have expired, so it is just another con trick designed to induce panic.

      I would just ignore it, but then I would probably ignore more drivel than most people on this forum. If you wanted to reply, you'd need to compose something which would refer to the previous statements concerning the possibility of doorstep harassment, and the missing prescribed terms template. It seems as though that was sent to another mob before 'ard 'un got involved, so you could send them a copy just for their own convenience.

          Just received a letter from them asking me to provide a list of income and expenditure, I suppose I ignore this one?

              They've now sent another letter complaining that I didn't return their income and expenditure form, that's 9 days they've allowed. They've offered another 7 days for me to return it.

                  Yes, I did that a few months back.

                  Latest letter arrived a few days ago.

                  They've now said I have to pay the "arrears" of some £2k by 10th December - if I do then no further enforcement action will be taken in respect of this breach.

                  If I don't pay up, which I won't as I cannot afford three months income in the space of two weeks then:

                  Further Action:

                  We will by written notice terminate the agreement and demand that you pay the whole balance outstanding, less any applicable rebate on interest. The current balance is shown above (it's about £9k) but this will increase if further charges are added due to the breach continuing.

                  After terminating the Agreement we may instruct debt collection agents to recover this debt on our behalf.

                  In then goes on about my rights for example I can apply to the court which may make an order allowing you more time and then goes on again to say I may have a default registered with the CRA, this was already done before the debt was sold a couple of years ago.

                  I have recently started a part time job but the income barely covers my bills so there's nothing spare to pay this debt and I've also moved house, should I tell them?

                  What's the next step?

                      I've had a couple of letters since the above, been busy over Christmas so not had chance to reply earlier.

                      First one dated 12th Dec, Notice to Terminate Your Loan Agreement.

                      Bascially stating if I don't pay within 5 days (are they for real?) then they will terminate my agreement and pass it to a debt collection agency. I thought that was what Ardun was?

                      They are also going to register a default with the CRA, but this was already done years ago.

                      Finally I've had a "FINAL DEMAND" in capitals,stating:

                      I am extremely concerned that despite our continued harassment you persist in refusing to address the outstanding balance. (I'm, paraphrasing) - actually it's because I CANNOT AFFORD TO PAY AS I HAVE TOLD YOU BEFORE.

                      It then goes on to threaten me with FURTHER ACTION, such as a VISIT TO MY HOME TO "DISCUSS" the matter, ooh, that sounds a bit threatening.

                      Or they may pass it to their solicitors to start legal proceedings.

                      We will review the account in 7 calendar days (is there any other kind? Do they mean the Gregorian or Julian calendar I wonder?)

                      I've actually moved house recently, should I tell them?

                      Advise welcome please, do I need do anything?

                          Another letter from Ard'un

                          Basically it says that they've tried to contact me on a number of occasions to try to set up a payment plan.

                          As they've not been able to do this they are now appointing an external company "Resolvecall" to attend my property to discuss the matter with me in person. A fee for this visit may be charged and may be subject to ongoing interest application. The maximum fee we are permitted to charge will not exceed £100 but is likely to be significantly less (how generous)

                          We hope at this stage you can contact us to discuss your account and agree an appropriate plan but if we do not hear from you within 5 days (letter dated 5th March so they aren't exactly giving me plenty of time, letter received on Friday 7th) then it says Resolvecall will schedule a visit and a fee may be levied on completion.

                          It then says to ring immediately.

                          So, what do I do with this one?

                          I think if they paid me £100 a pop to visit their clients I could pay the debt off in about 2 weeks, any chance of a job Ard'un?

                              How remarkably generous indeed, considering that it is pure stercus bovi.

                              If they still turn up after you have given them notice that they may not visit, remember there is bugger all they can lawfully do.

                              Keep the door closed and tell them to go away; if they don't, squirt water (or diluted apple juice) through your letterbox all over the front of their trousers.

                              They'll look like they've wet themselves.

                                They've sent me a letter saying they are sending someone round from "Resolvecall" to attend my property within 7 days unless they hear from me. The letter is dated 7 days ago.

                                Advice pls.
