Ok, so what Next sent was a random form, blank at that, detailing their terms - great, so what? What we're after is one specific to you and the account yopu agreed to, this is not what was sent and although they're using a recon, it's a blank one - nothing on it relates to your account.

          It is therefore

I would send this back: ---> CCA Query - Missing Prescribed Terms

I have recieved a letter from Capquest stating:

'You will see that the judge in Carey V HSBC determined that a copy of the document provided need not be a photocopy of the original nor need the copy provided be in the same format. The judge clarified that a copy of agreement may be reconstituted from other sources as long as it is produced honestly and accurately.

We have previously provided you with a reconstituted application form/agreement that has been reproduced honestly and accurately from other sources.Section 78 of the consumer credit act 1974 and the regulations provide that the documents provided under section 78 do not have to contain any signatures or signature boxes.'

Do i need to reply to this?

Is this the first letter from Capquest?
if so send the accound sold in dispute
if not I would resend the missing prescribed terms ( and everything else by the looks of it!)

I wouldn't, they'll always argue it's enforceable whether it is or not.
