    Once again many thanks Niddy (how will we ever repay your kindness) will send this letter with copy of first letter (that DLC intercepted) to them in about 10 days time, this will help toward SB time frame.

      Huge Gap in Correspondence from dlc and Hilesden Securities
      July - Received letter from dlc asking me to contact Argos Card Services regarding CCA copy (Ignored)

      November - Not heard from this lot for few months and they had a big break between 2010 and 2012 but today received a letter from dlc requesting that I pay them £10 per month to clear this debt .

      Sending copy of CCA and Default Notice to Niddy for his expert opinion - if we can remember how to do it...


      Niddy says.
      2013
      June - Letter from company called MDB (asspciate company of dlc who now own this account want to discuss account).
      June -Sent Niddy’s letter asking what’s their interest as according to Company’s house they are a Non Trading Company.
      July -Letter from dlc in reply to Niddy’s letter to MDB (stating MDB are a trading company)
      July - Another letter from MDB stating we have ignored 1st letter (it was redirected to dcl!!!)
      July - Sent another Niddy letter to dlc stating a formal complaint stating they are trying to decieve us by saying MDB are a trading company , even although states Non Trading in companys house.
      July - Received rely from dlc to our complaint stating MDB are a trading company and are acting agents for dlc and apologise if we thought they were trying to confuse us.
      July -Again sent another of Niddy;s great letters to dlc saying MDB DO NOT HAVE A CONSUMERS LICENCE.
      August -Received letter from dlc stating once again MDB are a trading company and copy of an entry stating they are trading and new set of T & C and CCA
      August -Sent new T & C and CCA and default notice to Niddy for checking
      August - Forgot to remember Niddy about me sending CCA, T & C and Default Notice, other more serious things cropped up.
      August - Received another letter from MDB stating:
      I have been instructed by direct legal & Collections an associated company of Mercantile Data Bureau Ltd to contact you about the above unpaid debt. Your account has been transferred to me due to your continued failure to discharge your current liability. All future contact relating to your account should now be with me.

      I would like to give you the opportunity to discuss your account with me before we undertake any action with your account. I will take into consideration your current financial circumstances
      and outline the many options available to help resolve this matter.
      I urge you to contact me today on 0000000000000 to conclude this matter as quickly as possible.
      Know Niddy away just now so can't ask him about CCA...any thoughts.
      September- Received letter again from MDB stating account eligable for 50% discount and remaining balance write off and CRA updated.
      September - Received letter from MDB stating basically they want paid.....
      September - Niddy complied yet, aother great letter for us telling MDB once again they are not licensed and not geting paid.

      October - Received reply for above letter we sent to MDB, the reply came from dlc stating they shall investigate my complaint and thheir client is Hillesdens Securities. Again this letter has been intercepted by dlc..Getting really confusing now. Letters coming from all angles MDB, dlc but stating its Hillesden Securities that owns it.

      Sent above letter to MDB in response to thier letter that we received. Once again this has been intercepted by dcl who have once again replied to say they acknowledge my complaint and will respond within 5 days. They state on thier letter Hillesden Securities is their client. Very confusing the game they are playing...You write to one company receive reply from another and they state someoe else is their client.

      We write to MDB telling them they are not licensed......letters are getting intercepted by dlc....who tell us Hillesden Secuirties is thier client, what the hell are they playing at.

        Don't stress about them
        I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website.             Received a response to above letter Niddy kindly helped me write to MDB. Got the response on Saturday (sorry couldn’t get on here any earlier lots of problems at this end to deal with just now, my Hubby not good and few other dilemmas affecting our family just now). I have typed out their response below, I don’t know how to scan (sorry)…..

            Niddy said this was UE last year as they only sent me application form, however a few weeks ago they sent me same application form but this time with T & C's at that particular time there was mega things going on with AAD so tried not to bother Niddy to much, maybe try and resend copies for his professional advice...


            This company now starting to p*** me off now, I have too many other personal problems going on just now, so god help the field agent that does turn up at our door.

            Dear xxxxxx

            We refer to your complaint letter dated xxxx addressed to Mercantile Data Bureau (MDB). This has been passed on to Hillesden Securities Ltd T/A direct legal & collections to respond.

            Complaint details (summary)

            Our understanding of your complaint is that you wish for MDB to stop harassing you. You state that you are in communication in regards to the outstanding balance and there is no need for a visit to your property. You state that MDB are not licensed and a report has been sent to the Office of Fair Trading.

            If our understanding of your complaint is incorrect, please inform us accordingly.


            Our findings

            Having investigated the claims raised we can confirm and advise the following:-

            · We have instructed Mercantile Data Bureau Ltd to act in regard to the above account.
            · Mercantile Data Bureau (MDB) Ltd is part of the Faccenda Group along with Hillesden Securities Ltd T/A direct legal & collections. MDV are a separate company to ourselves and hold their own consumer credit licence. Should you wish to view the details of this licence, you can do so by going to the Office of Fair Trading website.
            · MDB are a legally trading company and the appropriate returns will be submitted to Companies House in due course in line with statutory requirements. Due to the above we disagree with your claims that MDB are not licensed.
            · The last communication from you was July 2013 (THIS IS NOT TRUE) therefore we disagree with your comments that you are in communications with our company of MDB.
            · Due to the above point, we deny that any harassment has taken place within the meaning of section 1 of the Protection from Harassment Act 1997 or under section 40 of the Administration of Justice Act 1970. It is entirely reasonable for us, as the creditor, to communicate directly with the customer in relation to the repayment of an agreement entered into, especially where the customer is not legally represented we do communicate with the solicitors directly.
            · Should it be our intention to instruct our field agents, we can assure you that they will act in accordance with the guidelines issued by the Office of Fair Trading.
            · The balance of xxxx is correct and due. We would request you contact MDB to discuss the repayment options to you.

            Summary

            Further to the above, your complaint has not been upheld and your account will remain with MDB for collections activity to continue.

            We trust this now resolves the matter. Please confirm this by return wither in writing or by telephoning our offices by 14 October 2013.

              Hi Miss M, sorry that everything is a bit rough at home. They win through harassment and wearing people down. Send Niddy the latest paperwork. It is farcical that you have 48 hours to digest and reply to them. Make a note of the date it was received.

                Thanks for the reply, feel better already this forum seems to have that affect on people, obviously knowing there is kind hearted people out there prepared to take time out to listen and help peeps like us...this site is totally amazing.

                Yeah...you right they are trying their hardest to wear me down, their letter has post date franked on envelope 7/10/13 sent by second class postage we received 12/10/13 they want a reply by 14/10/13 (have noted date received on envelope and letter...will try (so much going on at this end to deal with just now) and get application form and T & C's (11 pages) to Niddy today (hate bothering him). Only about 8 months to go before rhis is SB so can only assume they are starting to panic..

                      Good Morning folks

                      Wee update....Fortunately not heard anything from dlc or MDB since 12/10/13 however new postman and mail seems to be going missing.

                      Unfortunately I have been in hospital past 10 days (Emergency admittance) and when I was away our Daughters were looking after things here and I received 2 letters from Link Financial Outsourcing for 2 Accounts they have had for several years but have more or less left us alone apart from sending statements and few letters.

                      Link state they are passing account to Instant Silver to chase these accounts but the last payment to these accounts I am sure was roughly 2007 (Scotland) so can I assume these are now SB. Would I write and advise them of this or just leave them to find out themselves. However if this meant attending Court I would rather advise them myself (Not in fit state just now). We received these letters just as I got admitted to hospital (21st Oct) but my Daughters thought it better that I didn't know about them due to my health, since then not heard anything from them (although as said above new postman who does not have a clue, we keep on getting neighbour's post so obviouly somebody is getting ours).

                      Any pointers appreciated...now to go and catch up with all whats been going on here at ADD since I have been away.

                            Many Thanks MrsD hopefully recovery on track another week or so shoud do the trick, yeah absolutely positive it was 2007, in fact since being on here early this morning (was taking withdrawal symptoms from AAD in hospital) found paperwork and it seems May 2007 was last payment and to my knowledge have never acknowledge this debt with them....over past 6 months they have sent letters offering huge discount which we have ignored.

                            But.. now they sent letter stating NOTIFICATION OF ACCOUNT TRANSFER TO AGENT stating they are instructing Instant Silver to take over managing these accounts....also checked through the paperwork I found this morning seems I have had few letters in the past from Instant Silver but manage to see them off.
